Heard Sri Pawan Kumar Vishwakarma, learned counsel for the applicant, Sri B.P. Maurya, learned AGA for the State-respondents and perused the record. 2. The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of applicant with a prayer to release him on bail in Case Crime No. 73 of 2026 under Sections 64(2)(Da), 351(3), 352 BNS, 5L/6 & 15(2) POCSO Act, 67A I.T. and sections 3(1)da, 3(1)dha S.C./S.T. Act registered at Police Station Bardah, District Azamgarh during pendency of the trial. 3. At the very outset, learned A.G.A. states that notice has been served upon the first informant. 4. It is also submitted that applicant has no criminal history and in case he is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings. 5. On the other hand, learned A.G.A. opposed the prayer for grant of bail to Versus Counsel for Applicant(s) : Karma Singh Yadav, Pawan Kumar Vishwakarma Counsel for Opposite Party(s) : G.A. On perusal of the impugned order passed by the learned Special Judge, it appears that he was not aware that applicant has already been granted bail by his Court on 31.3.2026 and the said order has been passed on merits and the fact of issuance of NBW against the applicant on 14.7.2026 is not mentioned in the said order. 7. Considering the entire facts and circumstances of the case, submissions of learned counsel for the parties and keeping in view the nature of offence, evidence, complicity of the accused and taking into account overcrowded jails and heavy pendency of criminal cases before the trial courts as well as considering the mandate of the judgement of the Apex Court in the case of Kapil Wadhawan vs Central Bureau of Investigation reported in 2025 SCC OnLine SC 3038 as well as guideline of this Court in the case of Maya Tiwari Vs.
