Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor appears for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023 in respect of Page No.# 2/3 Dispur P.S. Case No.121/2026 registered under Sections 103(1)/238/3(5) of the BNS, 2023. 3. The father of the petitioner armed with a knife and a hammer tried to kill his mother. The petitioner intervened and as a result of which the father died because of the knife injuries. 4. Mr. Goswami, learned Additional Public Prosecutor has submitted that the Case Diary should be called for. 5. Mr. Mahajan, learned counsel for the petitioner however, submits that this case falls within the purview of Section 38(a) of BNS. According to Mr. Mahajan if the petitioner had not intervened on that day his mother would have been killed by his father. 6. I have considered the submissions made by the learned counsel of both sides. 7. After hearing both sides I have decided to agree with Mr. Mahajan. The documents available in the record show that there was a scuffle between the deceased and his son and during the scuffle the deceased sustained knife injuries as a result of which he expired. 8. Under the aforesaid circumstances, this Court is of the opinion that there is no necessity to keep the petitioner in custody for further period of time. Therefore, the bail application is allowed. 9. Accordingly, the petitioner Ryan Choudhury who was arrested in connection with Dispur P.S. Case No.121/2026 registered under Sections 103(1)/238/3(5) of the BNS, 2023, shall be released on bail of ₹25,000/- (Rupees twenty five thousand) only with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Assam.
