Heard Mr. M. Khan, learned counsel for the applicant. Also heard Mr. P.S. Lahkar, learned Additional Public Prosecutor for the State respondent. 2. Apprehending arrest in connection with a Non-FIR case of Lala P.S., this application under Section 482, BNSS is preferred by applicant, namely, Kamran Akmol Laskar, for grant of pre-arrest bail. 3. It is to be noted here that this Court, vide order dated 24.06.2026, had called for a report from the Lala P.S. if any case has been registered in Lala P.S.

And accordingly, Mr. Lahkar, learned Additional Public Prosecutor for the State respondent, has procured a report dated 26.07.2026, from the Officer-in-charge, Lala P.S. and placed the same before this Court. 4. Perusal of the report dated 26.07.2026, indicates that no case has been registered against the present applicant till date, though one FIR has been received and entered in the General Diary, vide Lala P.S. G.D. Entry No. 17, dated 14.06.2026 and entrusted one SI Jainal Abedin Choudhury for conducting preliminary enquiry and for submitting a report at an early date as to whether the allegations disclosed the commission of a cognizable offence or were predominantly of a civil nature, and that enquiry is still going on and no formal police case has yet been registered and no case diary has been opened or maintained as on date. 5. It is to be noted here that the FIR was lodged on 14.06.2026, by one Jaynal Abdin Khan alleging that Kamran Akmol Laskar and his father Salim Uddin Laskar induced him to invest an amount of Rs. 78,00,000/- in a business transaction on the assurance that the principal amount, along with business profits would be returned, and believing their representation, the informant entrusted the said amount to them.
But, subsequently, despite repeated demands and requests, Kamran and his father failed and refused to return the money and they had dishonestly misappropriated the entrusted amount and cheated him and thereby caused substantial financial loss and mental harassment to him. 6. In view of the allegation made in the FIR dated 14.06.2026, as is apparent from the report of the Officer-in-charge, Lala P.S. dated 26.07.2026, this Court is of the view that apprehension of arrest is there in the event of registration of
Page No.# 3/3 the FIR, which the petitioner herein has demonstrated in his petition. It is also well settled in the case of Gurbaksh Singh Sibbia Etc. vs. State of Punjab, reported in (1980) 2 SCC 565, that even if FIR is not filed, the prayer for pre-arrest bail can be considered. Under the given factual and legal backdrop, this Court is inclined to grant the privilege of pre-arrest bail to the applicant at this stage. 7. Accordingly, it is provided that in the event of arrest of the applicant in connection with FIR, dated 14.06.2026, lodged by Jaynal Abdin Khan with Lala P.S., he shall be released on pre-arrest bail on executing a bond of Rs. 20,000/- with one surety of like amount to the satisfaction of the arresting authority. The above privilege is, however, subject to the following conditions: (i) The applicant shall make himself available for interrogation by the Investigating Officer as and when directed; (ii) The applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; and (iii) The applicant shall not leave the jurisdiction of the learned CJM, Hailakandi, without prior permission. 8. In terms of above, this application stands disposed of. 9. The report dated 26.07.2026, produced by Mr. Lahkar, shall be marked as ‘X’ and tagged with the record. JUDGE Comparing Assistant
