The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking quashing of FIR No. 803/2025, registered at Police Station Wazirabad, Delhi, under Sections 420 and 406 of the Indian Penal Code (hereinafter referred to as the ‘IPC’) and all consequential proceedings emanating therefrom. 3. Issue notice. Learned APP for the State accepts notice 4. The Petitioners and Respondent No. 2 are present before this Court and have been identified by the Investigating Officer (IO) concerned. 5. Ltd., executed an Agreement to Sell dated 30.01.2021 in favour of Respondent No. 2 in respect of an immovable property measuring 13.26 acres situated at Village Burari, Delhi, for a total sale consideration of Rs.9,28,20,000/-. It is alleged that Respondent No. 2 paid a sum of Rs.47,50,000/- towards the sale consideration. Subsequently, disputes arose between the parties regarding the said transaction, pursuant to which Respondent No. 2 lodged the present FIR alleging commission of offences punishable under Sections 406 and 420 of the IPC against the Petitioners. 6. Learned counsel for the Petitioners submits that, during the pendency of the proceedings, the parties have amicably resolved all their disputes and entered into a Settlement Agreement dated 20.05.2026. It is further submitted that, in terms of the said Settlement Agreement, the balance settlement amount of Rs.35,00,000/- by way of Demand Draft bearing No. 557709 dated 07.07.2026, drawn on Punjab National Bank, Kailash Colony Branch, New Delhi, in favour of Respondent No. 2, has been handed over to Respondent No. 2 in Court today. With the said payment, the terms and conditions of the Settlement Agreement stand fully complied with and nothing further remains to be paid by either party thereunder. 7. On a query made by this Court, Respondent No. 2, who has been duly identified by the IO, categorically states that he has entered into the Settlement Agreement out of his own free will, without any force, coercion or undue influence. He further states that the entire settled amount has been received by him and that he has no surviving claim whatsoever against the Petitioners. He has no objection if the present FIR and all proceedings emanating therefrom are quashed. 8. In view of the fact that the parties have amicably resolved all their This is a digitally signed order. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case. 9. Accordingly, FIR No. 803/2025, registered at Police Station Wazirabad, Delhi, for the offences punishable under Sections 420 and 406 IPC, and all consequential proceedings emanating therefrom, are hereby quashed. 10.
