This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.32/2026 registered at Police Station – Champa, District- Janjgir-Champa (C.G.) for the offences punishable under Sections 376(2)(n) of the IPC and Section 4 & 6 of the Protection of Children of Sexual Offences Act. The case of the prosecution, in brief, is that on 29.01.2026 the prosecutrix lodged a complaint alleging that the applicant, during the period from 31.12.2021 to 07.03.2023, established physical relations with her on the pretext of marriage and thereby committed the alleged offence. It is stated that the matter is sensitive in nature; therefore, the copy of the FIR has not been annexed with the present application. On the basis of the said complaint, the police registered the case and initiated investigation against the applicant. 3. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case. He further submits the prosecutrix, who was aged about 21 years at the time of lodging the complaint, has alleged that the applicant established physical relations with her on the assurance of marriage during the period from 31.12.2021 to 07.03.2023; however, the said allegations are false and have been made only with an ulterior motive to implicate the applicant in a serious criminal case. It is further submitted that the applicant had borrowed a sum of 50,000/- from the prosecutrix and, ₹ due to non-payment of the said amount, the prosecutrix has lodged the present false complaint out of personal grudge. Prior to registration of the present FIR, the prosecutrix had submitted a written complaint dated 22.01.2026, wherein she only alleged that the applicant had borrowed Rs.50,000/- and did not disclose any date or allegation of such incident, which clearly reflects that the present allegations are an afterthought and motivated. The applicant craves leave of this Hon’ble Court to raise additional grounds at the time of hearing, undertakes to furnish adequate surety, and assures that he shall abide by all terms and conditions imposed by this Hon’ble Court. 3 4. On the other hand, learned State counsel as well as learned counsel for the objector opposed the prayer for grant of anticipatory bail of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and the nature of the allegations levelled against the applicant, it appears that the prosecutrix was a major and that both parties were acquainted with each other and were in a consensual relationship, during which physical relations were established. Subsequently, when the relationship did not culminate in marriage, the present FIR appears to have been lodged on the allegation that the applicant refused to marry her. Therefore, without expressing any opinion on the merits of the case, this Court is inclined to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Aman Dewangan, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. 4 (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
