This application under Section 430 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, is preferred by the applicant for suspension of the judgment and order dated 24.04.2026, passed by the learned Sessions Judge, Chirang, in Criminal Appeal No.23/2025 and also the impugned judgment and order dated 31.05.2025, passed by the learned Additional Chief Judicial Magistrate, Chirang, Kajalgaon, in NICR Case No.16/2023. Perused the application and the documents placed on record and also perused the judgment and order dated 24.04.2026, passed by the learned Sessions Judge, Chirang, in Criminal Appeal No.23/2025 and also the impugned judgment and order dated 31.05.2025, passed by the learned Additional Chief Judicial Magistrate, Chirang, Kajalgaon, in NICR Case No.16/2023. Mr. Ali, learned counsel for the applicant submits that the connected criminal revision petition has already been admitted by this Court and as such, there is a requirement of staying the operation of the impugned judgment and order dated 24.04.2026, passed by the learned Sessions Judge, Chirang, in Criminal Appeal No.23/2025 and also the impugned judgment and order dated 31.05.2025, passed by the learned Additional Chief Judicial Magistrate, Chirang, Kajalgaon, in NICR Case No.16/2023. Having considered the submission of learned counsel for the applicant and also considering the facts and circumstances on the record, it is provided that the impugned Page No.# 3/3 judgment and order dated 24.04.2026, passed by the learned Sessions Judge, Chirang, in Criminal Appeal No.23/2025 and also the impugned judgment and order dated 31.05.2025, passed by the learned Additional Chief Judicial Magistrate, Chirang, Kajalgaon, in NICR Case No.16/2023, stand stayed, till dispose of the connected criminal revision petition.
