JUSTICE BALJINDER SINGH SANDHU Order 04/08/2026 Heard learned counsel for the parties, and perused the material available on record. [2026:RJ-JP:36623] (2 of 3) [CRLMB-9527/2026] The petitioners have been arrested in connection with FIR No.255/2026 of Police Station New Mandi Gharsana, District Sri Ganganagar, for the offences punishable under Sections 8/15 and 25 of NDPS Act. They have preferred these bail applications under Section 483 of BNSS. Learned counsel for the petitioners submits that the alleged contraband 25 kg poppy straw has been recovered and the recovery has been effected from the vehicle which is below commercial quantity. It is stated that there are no criminal antecedents against the petitioners as well as no case is registered against them under NDPS Act and the petitioners are behind the bars since 29.06.2026 and the trial is likely to take considerable time to conclude. Per contra, learned Public Prosecutor has vehemently opposed the bail application. This Court has considered the arguments advanced by learned counsel for the petitioners and finds that the alleged contraband 25 kg poppy straw has been recovered and the recovery has been effected from the vehicle which is below commercial quantity. It is stated that there are no criminal antecedents against the petitioners as well as no case is registered against them under NDPS Act and the petitioners are behind the bars since 29.06.2026. Hence, keeping in view the overall facts and circumstances of the case; conclusion of the trial of the case is likely to take time; the narcotic contraband alleged to be recovered from the petitioner is below commercial quantity; the prosecution has not [2026:RJ-JP:36623] (3 of 3) [CRLMB-9527/2026] shown any apprehension of the petitioner fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioner under Section 483 of BNSS. Accordingly, these bail applications filed under Section 483 of BNSS are allowed and it is directed that petitioner – Mangu Ram S/o Wasan Ram, Vijay Kumar S/o Surendra Kumar, Prithviram S/o Karamchand, and Jai S/o Prithviram, shall be released on bail in connection with aforesaid FIR, if not wanted in any other case, provided they executes a personal bond in the sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
