This application under Section 430(1) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, is preferred by the applicant for suspension of the sentence passed by the learned Chief Judicial Magistrate, Chirang, Kajalgaon, in NICR Case No.29/2023, vide judgment and order dated 30.08.2025 and the judgment and order dated 10.12.2025, passed by the learned Sessions Judge, Chirang, in Criminal Appeal No.32/2025. Perused the application and the documents placed on record and also perused the judgment and order dated 30.08.2025, passed by the learned Chief Judicial Magistrate, Chirang, Kajalgaon, in NICR Case No.29/2023, which has subsequently been affirmed by the learned Sessions Judge, Chirang, in Criminal Appeal No.32/2025, vide judgment and order dated 10.12.2025. Mr. Boruah, learned counsel for the applicant submits that the connected criminal revision petition has already been admitted by this Court and as such, there is a requirement of staying the operation of the impugned judgment and order dated 30.08.2025, passed by the learned Chief Judicial Magistrate, Chirang, Kajalgaon, in NICR Case No.29/2023 and also the judgment and order dated 10.12.2025, passed by the learned Sessions Judge, Chirang, in Criminal Appeal No.32/2025. Having considered the submission of learned counsel for the applicant and also considering the facts and circumstances on the record, it is provided that the impugned judgment and order of conviction dated 30.08.2025, passed by the learned Chief Judicial Magistrate, Chirang, Kajalgaon, in NICR Case No.29/2023 and also the judgment and order dated 10.12.2025, passed by the learned Sessions Judge, Chirang, in Criminal Appeal No.32/2025, stand stayed, till dispose of the connected criminal revision petition.
