ORDER 30.07.2026 Heard Mr. K. Boruah, learned counsel for the applicant. This application under Section 430(1) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, is preferred by the applicant for suspension of the sentence passed by the learned Additional Chief Judicial Magistrate, Golaghat, in CR(NI) Case No.28/2016, vide
judgment and order dated 05.04.2021 convicting the applicant under Section 138 of the N.I. Act and the judgment and order dated 25.02.2026, passed by the learned Sessions Judge, Golaghat, in Criminal Appeal No.26/2021, upholding the order passed by the learned Trial Court. Perused the application and the documents placed on record and also perused the
judgment and order dated 05.04.2021, passed by the learned Additional Chief Judicial Magistrate, Golaghat, in CR(NI) Case No.28/2016, which has subsequently been affirmed by the learned Sessions Judge, Golaghat, in Criminal Appeal No.26/2021, vide judgment and order dated 25.02.2026. Mr. Boruah, learned counsel for the applicant submits that the connected criminal revision petition has already been admitted by this Court and as such, there is a requirement of staying the operation of the impugned judgment and order dated 05.04.2021, passed by the learned Additional Chief Judicial Magistrate, Golaghat, in CR(NI) Case No.28/2016 and also the judgment and order dated 25.02.2026, passed by the learned Sessions Judge, Golaghat, in Criminal Appeal No.26/2021. Having considered the submission of learned counsel for the applicant and also considering the facts and circumstances on the record, it is provided that the impugned
judgment and order of conviction dated 05.04.2021, passed by the learned Additional Chief Judicial Magistrate, Golaghat, in CR(NI) Case No.28/2016 and also the judgment
