Also heard Mr. N Das, the learned Govt. Advocate, Assam. 2. The present writ petition has been filed by the petitioner being aggrieved by the non-registration of the FIR filed by the petitioner against the accused persons as per law. 3. It is the opinion of this Court that if the petitioner is aggrieved by the non- registration of the FIR, the remedy of the petitioner lies under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Taking into account the judgment of the Supreme Court in the case of Sakiri Vasu Vs. the State of Uttar Pradesh and others, reported in (2008)2 SCC 409, this Court is not inclined to entertain the instant writ petition. 5. Accordingly, the writ petition stands dismissed being not entertained. 6. The dismissal of the instant writ petition shall not prejudice the rights of the petitioner to approach the concerned Jurisdictional Magistrate, if so advised. JUDGE Comparing Assistant
