2. For the reasons stated in the application, the same is allowed.
3. Delay of 189 days in filing this appeal is hereby condoned.
4. At this stage, learned counsel appearing for the parties jointly submit that the appellant/claimant and respondent No.02/Insurance Company have amicably settled the dispute out of the Court on an agreement that in addition to the amount of compensation awarded by the learned Claims Tribunal to the appellant/Claimant, the respondent No.2/Insurance Company herein will pay Rs.1,30,000/- (Rupees One Lakh Thirty Thousand Only) to the appellant/Claimant herein within a period of 30 from the date of this order without any interest.
5. The aforesaid submission is taken on record.
6. Accordingly, the respondent No.02- Insurance Company is directed to deposit the said agreed amount i.e. Rs.1,30,000/- (Rupees One Lakh Thirty Thousand Only) without interest to the appellant/Claimant within a period of 30 days from today. However, rest of the conditions of the impugned award shall remain intact. Hence, this appeal stands finally disposed of in view of aforesaid settlement arrived at between the parties.
