JUSTICE D K SINGH) The present writ petition has been filed impugning the order dated 09.02.2026 passed by the learned Sole Arbitrator (Sri K.N.Keshavanarayana, Former Judge of this Court) in the matter of Arbitration Case No.231/2024. 2. The evidence of the claimant was closed on 06.01.2025. The evidence of the respondents was also closed thereafter. The matter was fixed for final arguments on merit on 05.12.2025. Nearly after a year from the date of closing the evidence of the claimant. The petitioner/claimant filed an application to recall the CW-1/Madhu Kapoor for further examination on the documents which were sought to be produced by filing separate applications. The respondent had objected to these applications and after hearing both the - 3 - HC-KAR NC: 2026:KHC:14091-DB WP No. 7581 of 2026 parties on the applications for further examination of the CW-1 Madhu Kapoor and as well as for production of certain documents, the learned Arbitrator has rejected the applications seeking production of the documents as well as for recalling the CW-1 for further examination. 3. We have gone through the impugned order passed by the learned Arbitrator and find it to be in quiet detail. We are of the considered view that the impugned order is neither perverse nor suffers from any glaring illegality. We find no reason to interfere with the impugned order and therefore, the present writ petition stands dismissed. However, the petitioner may take all the arguments which may be available to him at the time of subsequent proceedings under Section 34 of the Arbitration and Conciliation Act, 1996 after the final award is passed.
