KAMAL Digitally signed by SUMA B N Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2026:KHC:21556 CRL.P No. 16872 of 2025 ORAL ORDER The present petition is by accused No.8 in SC No.42/2025 seeking grant of regular bail for the offences punishable under Sections 103(2), 61(1)(b), 190, 238 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) pending on the file of the I Additional District and Sessions Judge, Chikkaballapura. 2. Learned counsel for the petitioner has filed a memo along with the copies of the orders passed in Criminal Petition No.14608/2025, Criminal Petition No.14586/2025, Criminal Petition No.15592/2025 and Criminal Petition No.14973/2025, in terms of which, the Co-ordinate Benches of this Court have granted bail to accused Nos.1, 7, 9 and 11, respectively. 3. The learned counsel for the petitioner further submits that perusal of the entire complaint averments and the charge sheet do not indicate any overtact having - 3 - HC-KAR NC: 2026:KHC:21556 CRL.P No. 16872 of 2025 been attributed to accused No.8, except stating that he had made an attempt to smash the head of the deceased by a sized stone which had missed and that no material is recovered at the instance of accused No.8. He further submits that the entire case is based on circumstantial evidence. Besides, since accused Nos.1,7,9 and 11, against whom the overtact was attributed having been granted bail, the petitioner is also entitled for bail on the basis of parity. 4. The learned HCGP does not dispute grant of bail by the Co-ordinate Benches of this Court to accused Nos. 1, 7, 9 and 11, against whom overtact has been alleged. 5. In the circumstances, this Court deems it appropriate to grant bail to the petitioner subject to following conditions: ORDER (i) Criminal Petition filed under Section 483 of BNSS, 2023 is allowed. - 4 - HC-KAR NC: 2026:KHC:21556 CRL.P No. 16872 of 2025 (ii) The accused/petitioner is directed to be enlarged on bail in Crime No.22/2025 for the offences punishable under Sections 103(2), 61(1)(b), 190, 238 of Bharathiya Nyaya Sanhitha, 2023, subject to the following conditions: a) the accused/petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two local sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The accused/petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The accused/petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The accused/petitioner shall not involve in similar offences in future; e) The accused/petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until - 5 - HC-KAR NC: 2026:KHC:21556 CRL.P No. 16872 of 2025 the case registered against him is disposed off.
