Baishya, learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023 whereby the petitioner, namely, Sri Golab Rabbani is seeking Anticipatory Bail apprehending
Page No.# 2/3 arrest in connection with an FIR dated 01.05.2026, which is registered as Howly Case No. 53/2026 registered under Section 107 of BNS, 2023. 3. The allegations as per the FIR lodged by the brother of the victim is that the petitioner was in a love relationship with the minor sister of the informant and the petitioner used to inflict physical and mental torture upon the victim because of which she took her life on 20.04.2026 by hanging herself and that on the day of occurrence she had called the accused person and told him that she would commit suicide within 10 minutes and also as per mobile recording of his sister the cause of her death was physical and mental torture inflicted upon her by the accused person. 4. Learned counsel for the petitioner submits that there is no abetment by way of instigation or otherwise on the part of the petitioner in the commission of the suicide by the victim and the petitioner himself is a young person aged about 20 years, who was in a love relationship with the victim. 5. The Case Diary as called for has been received, wherefrom it appears that the mobile phone of the victim has been seized and sent for forensic examination. Although the Investigating Officer has stated that as per the CDR several messages were exchanged between the petitioner and the victim on the date of occurrence and according to the informant there is also a video recording of their conversation, nothing of that sort is available in the case dairy.
Therefore, at this stage, it cannot be said that there is material to indicate that the accused had abetted the commission of suicide by any instigation or otherwise. 6. Having regard to the above, the prayer for pre-arrest bail is allowed. The
Page No.# 3/3 petitioner in the event of his arrest in connection with the aforesaid case shall be released on bail of Rs.50,000/- (Rupees fifty thousand) only with two suitable sureties of like amount to the satisfaction of Arresting authority. 7. It is further provided that the petitioner shall appear before the Investigating Officer within a period of 10 (ten) days from today for the purpose of interrogation and that he shall not try to influence or intimidate the witnesses or tamper with the evidence in any manner. 8.
