JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents. 2. It is the contention of the petitioner that the petitioner has filed an application in Form No.53 on 05.12.1998 seeking regularization of unauthorized occupation of 2 acres of land in Survey No. 249 of Sathanur Village, Kasaba Hobli, Mandya Taluk, Mandya District. It is contented that on 14.02.1998, the petitioner has paid T.T.charges of Rs.473/- in terms of the challan issued to the petitioner. However till date no orders were passed for regularization and therefore the prayer in this petition is to issue a writ of mandamus directing the respondent-Tahsildar/Secretary, Committee for regularization of unauthorized occupants to consider the - 3 - HC-KAR NC: 2026:KHC:9173 WP No. 4545 of 2026 application filed by the petitioner and pass necessary orders and till consideration of the application not to disturb the possession of the petitioner. 3. Having regard to the contentions raised in the writ petition and submission of the learned counsel for the petitioner, this Court is of the considered opinion that respondent No.4-Tahsildar was duty bound to place the application filed by the petitioner before the ‘Committee for Regularization of Unauthorized Occupation’ and the Committee was also duty bound to consider the application and pass necessary orders. 4. The writ petition stands disposed of with a specific direction to respondent No.4-Tahsildar, Mandya Taluk, to verify from the records as to whether such an application filed by the petitioner in the year 1998, is pending consideration. If it is found that such an application was indeed filed by the petitioner and the application is yet to be considered, the respondent No.4- Tahsildar is directed to place before the Committee, the - 4 - HC-KAR NC: 2026:KHC:9173 WP No. 4545 of 2026 application along with his recommendation within a period of four weeks from the date of receipt of a copy of this order. Thereafter, Committee shall consider the application and pass necessary orders in accordance with law as expeditiously as possible and at any rate within a period of two months thereafter. 5. Needless to observe that till the application of the petitioner is considered and orders are passed, no precipitate action shall be taken to dispossess the petitioner from the lands in question. 6.
