2026:JHHC:4553 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 45 of 2026 ------ Md. Zahid, S/o Md. Suleman, R/o Village- Sibla and at present R/o Village- Rahmatnagar, PS- Bariyatu, PO- Balumath, Distt :- Latehar, Jharkhand. .... .... …. Petitioner Versus State of Jharkhand .... .... .... Opposite Party ……….. CORAM: HON'BLE MR. JUSTICE GAUTAM KUMAR CHOUDHARY ……….. For the Petitioner : Mr. B. M. Tripathi, Sr. Advocate Mr. Naveen Kr. Jaiswal, Advocate For the State : Mr. Pankaj Kr., PP ------ Order No.2 / Dated : 17.02.2026. Heard both the sides. The petitioner, above-named, who is in custody in connection with Balumath (Latehar) P.S. Case No. 213 of 2018 (NDPS Case No.01B/ 2020) for the offence registered under Sections 15 (C) / 22/ 29 of the NDPS Act has prayed for regular bail. As per the prosecution case, on secret information, a raid was conducted on 09.11.2018 in the house of one Suleman Mian in which 800 Kg. of opium was seized from the store room of his house and further 540 Kg of opium was seized from the pick-up van parked outside the store room. The FIR was lodged against said Suleman Mian and his two sons, namely, Md. Zahid and Md. Daud. It is submitted by the learned counsel on behalf of petitioner that brother of the petitioner, namely, Md. Daud @ Daud Alam was arrested and has been enlarged on bail by the Co-ordinate Bench of this Court in B.A. No.2227 of 2020. It is further submitted that allegation is mainly directed against his father, namely, Suleman Mian and he has been roped in this case mainly on suspicion. The case of this petitioner stands on similar footing to that of his brother, Md. Daud who has already been granted bail by the Co-ordinate Bench of this Court. Learned P.P. for the State has vehemently opposed the prayer for bail. It is submitted that the matter involves an organized crime by trafficking of narcotics in which apart from huge quantity of Doda was seized from the house and further two bags of 40 Kg. each of Doda were also seized from the Bolero Vehicle bearing Registration No.JH01BL- 5751. This petitioner has been absconding for the last seven years and charge-sheet has been submitted 2026:JHHC:4553 2 showing him to be absconder. It is contended that rigors of Section 37 of the NDPS Act will apply in the facts and circumstances of the case. In this regard, reliance has been placed on 2025 SCC OnLine SC 3049 [Union of India vs. Namdeo Ashruba Nakade]. Matter appears to be seizure of commercial quantity of narcotics from the house and also from the vehicle of this Petitioner. Petitioner was absconding almost for seven years, and his father is still at large. Considering the facts and circumstances of the case, the prayer for bail of the petitioner, is hereby, rejected.
