JUSTICE V SRISHANANDA ORAL ORDER Learned counsel for the petitioner has filed a memo reporting the death of petitioner. 2. The memo reads as under: "1. It is submitted that, on 20.09.2021, the above revision petition was filed by the revision petitioner challenging the legality and correctness of the judgment passed by the Hon'ble the 18th Additional Metropolitan Magistrate at Bangalore in C.C.No.17161/2006 and confirmed by the Hon'ble 65th additional city civil and session judge at Bangalore in Crl.A.No.1051/2018 on dated 21.08.2021. 2. It is further submitted that, the above matter was listed before the bench on dt:21.04.2021 this Hon'ble Court pleased to admitted the case and allowed IA No.1 for suspension of the sentence of petitioner/accused and issue emergent notice to the respondent herein and directed the - 3 - HC-KAR NC: 2026:KHC:13804 CRL.RP No. 39 of 2022 revision petitioner to deposit 50% of the fine amount passed by the Trial Court. 3. It is further submitted that, in the meantime the relatives and friends advised revision petitioner to settle the issue amicably without further legal obligation at his retirement legal complication at the age of 60 year as a senior citizen. Hence, revision petitioner made a submission before this Hon'ble court and showing willingness to clear Rs.1,00,000/- and as full and final settlement and he had already deposited Rs.33,000/- before the trial court on 2607.2018. Hence, the revision petitioner had taken the remaining amount in way of demand draft of Sri.Laxminarayana cooperative bank limited, head office, rama manohara branch, Bangalore-560 021 of Rs.68,000/- on dt.13.07.2023 in the name of Registrar General High Court of Karnataka at Bangalore and same was produced before this Hon'ble Court along with memo on dt: 14.07.2023. 4. It is further contended that, the recently the family members of the revision petitioner told that the revision petitioner was passed away because of his ill health on dt: hence, they advised to produce the death certificate issued by the BBMP before this Hon'ble court for kind perusal. In such circumstance it is a primary duty of petitioner counsel to notify the same before this Hon'ble Court for further order according to the law hence, present memo is filed along with the death certificate of the revision petitioner herein.
