2. This petition is at the instance of the complainant. He prays to recall the order dated 13.06.2025 passed in A.B.A. No.3250 of 2025, whereby the O.P. No.2 was directed to surrender in terms of order passed in the case of “Satender Kumar Antil vs. Central Bureau of Investigation and Another”, reported in (2021) 10 SCC 773 and the Trial Court was directed to accept the bail bonds.
3. The case arises out of a complaint. In a case arising out of a compliant there is no scope of investigation. Only the Court has to see whether the accused will face trial or not. There is nothing on record to suggest that the accused will not face the trial.
4. Considering the aforesaid fact, this Court vide order dated 13.06.2025 passed in A.B.A. No.3250 of 2025 directed the O.P. No.2 to surrender in terms of order passed in the case of “Satender Kumar Antil vs. Central Bureau of Investigation and Another”, reported in (2021) 10 SCC 773. On the merits of this case, I find that no ground to reconsider the aforesaid order, accordingly, the instant Cr.M.P. is hereby dismissed.
