1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 208/2026 registered at Police Station – Sakri, District Bilaspur (C.G.) offence under Sections 281, 125(a), 105 of the Bhartiya Nyay Sanhita, 2023. 2. As per the prosecution story, in brief, a report was lodged at Police Station Sakri to the effect that on 27.02.2026, Chhatrapal Ratre, Vishal Lahre, Devendra Miri, Anmol Lahre, and Chandraprakash were returning from Yadav Dhaba in a Mahindra Scorpio bearing registration No. CG- 04-MQ-4220. At that time, their vehicle was hit by an offending trailer ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.05.06 18:43:54 +0530
2 bearing registration No. CG-11-BD-9044, as a result of which Chhatrapal Ratre, Vishal Lahre, Anmol Lahre, and Devendra Miri sustained grievous multiple injuries and died on the spot. On the basis of the said report, an FIR was registered against the driver of the trailer bearing registration No. CG-11-BD-9044, and during the course of investigation, the applicant was arrested. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case. He submits that the applicant is a driver by profession and holds a valid and effective driving licence to drive heavy vehicles. He also submits that the accident occurred due to some technical fault in the trailer, and the applicant was not driving the said vehicle in a rash or negligent manner. The applicant is the sole breadwinner of his family, and his prolonged pre-trial detention will adversely affect his family’s livelihood. He submits that the applicant has no criminal antecedents and he is in jail since 28.02.2026, conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of regular bail to the applicant. 4.
On the other hand, learned State counsel opposes the bail application and also endorse the submission made by the learned counsel for the applicant that he has no criminal antecedents. She also submits that the charge-sheet has been submitted in the present case before the competent Court. She further submits that the applicant, as driver of the offending trailer bearing No. CG-11-BD-9044, caused a fatal accident by rash and negligent driving, resulting in the death of four persons on the spot. Considering the gravity of the offence, the loss of multiple lives, and the seriousness of allegations supported by the FIR and investigation, no case for grant of bail is made out at this stage. 5. I have heard learned counsel appearing for the parties and perused the
3 case diary. 6. Considering the submissions advanced by learned counsel for the applicant, particularly that the accident is stated to have occurred due to a technical fault in the vehicle and not on account of rash or negligent driving, further, the fact that the applicant has no criminal antecedents, the charge-sheet has already been filed before the competent Court and the applicant has been in jail since 28.02.2026, and that the conclusion of the trial is likely to take considerable time, this Court is of the considered view that the present applicant is entitled to be released on bail in this case. 7. Let the Applicant – Navratan Singh Uike, involved in Crime No. 208/2026 registered at Police Station – Sakri, District Bilaspur (C.G.) offence under Sections 281, 125(a), 105 of the Bhartiya Nyay Sanhita, 2023, be released on bail on furnishing personal bond with two sureties in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court.

(ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufÏcient cause, the trial court may proceed against his under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicant misuses the liberty of bail during
