Petitioner has filed this writ petition seeking following reliefs: “10.1 That the Hon’ble Court may kindly be pleased to direct the respondents to release the petitioner’s pension along ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2026.01.14 10:57:05 +0530 2 / 3 with all the GPF and other consequential benefits along with 15% interest. 10.2 That the Hon’ble court may kindly be pleased to count the suspension period of the petitioner as work period and grant salary to the petitioner along with interest. 10.3 That the Hon’ble court may kindly be pleased to direct the respondent State to grant any other relief which this Hon’ble Court deems fit and proper in favour of the petitioenr as per the facts and circumstances of the present case, in the ends of justice.” 2. Learned counsel for petitioner submits that petitioner was appointed as clerk grade-III on adhoc basis in the year 1984 and continued on the said post. Petitioner stood retired on 27.06.2025, however, till date the retiral dues of petitioner has not bee paid. She submits that earlier one FIR was registered against the petitioner for alleged commission of offence punishable under Section 420, 467, 468, 120B of Indian Penal Code and Section 13(1) (d), 13(2) of Prevention of Corruption Act, 1988. Registration of crime was put to challenge in CrMP No. 2228 of 2025 and petition was disposed of observing that the said petition has rendered infructuous as closure report with regard to petition has been filed. She further submits that in the aforementioned facts of the case, as of now, there is no criminal case against the petitioner, therefore, petitioner is entitled for all retiral benefits. Petitioner has also submitted multiple representation before respondent no. 3, however, no representation has been decided, therefore this writ petition is filed. She lastly submits that pursuant to representation submitted by petitioner, respondent no. 3 has already written letter to respondent no. 1 seeking guidance for deciding the claim of petitioner. 3 / 3 3. Learned counsel for State submits that instructions are still awaited. She however, submits that as the petitioner has already submitted representation if it is still pending consideration appropriate orders will be passed. However, she submits that the representation submitted by the petitioner is quite old and if petitioner submits a fresh representation it will be considered and decided in accordance with law. 4. I have heard learned counsel for respective parties. 5. Considering the facts and circumstances of the case, nature of grievances raised in this writ petition, and further considering that petitioner has already submitted representation before respondent no. 3, instead of keeping this writ petition pending and seeking reply from the respondents, it will be in the interest of parties, if this writ petition at this stage be disposed of directing respondent no. 1 and 2 to take decision on claim of petitioner. 6. Accordingly, the writ petition is disposed of permitting petitioner to submit fresh representation along with all the relevant documents and in the event petitioner submits such representation, respondent no. 1 and 2 shall take decision in accordance with law, expeditiously, preferably within a further period of 06 weeks from the date of receipt of the representation. 7.
