The petitioner is apprehending his arrest in connection with Sisai P.S. Case No.116/2025, registered for the offence under Sections 316(2), 318(4), 338, 336(3), 340(2), 61(2) of the BNS, pending in the Court of the learned Sub Divisional Judicial Magistrate, Gumla. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be Mukhiya of Pandaria panchayat and the allegations are made that one Ramdhari Singh has sold the land to accused nos. 3, 4 and 5. He next submits that the said Ramdhari Singh has prepared the genealogical table and the petitioner has only certified the same. He then submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 14 of this application. He also submits that the purchasers of the land have been provided privilege of anticipatory bail by this Court in A.B.A. No.7329 of 2025 and A.B.A. No.7363 of 2025, vide orders dated 19.12.2025 and 22.12.2025 respectively. 4. Learned counsel appearing for the State opposed the prayer and ( 2026:JHHC:111 ) -2- A.B.A. No. 7493 of 2025 submits that the allegations are there against the petitioner of certifying genealogical table submitted by Ramdhari Singh. 5. Learned counsel appearing for the informant opposed the prayer and submits that the petitioner being the Mukhiya, has prepared forged genealogical table. He further submits that the case is coming within the scope of Section 338 of the Bharatiya Nyaya Sanhita, 2023. He next submits that two months prior to sale of the land, another genealogical table was also prepared by the petitioner. On these grounds, he submits that this anticipatory bail application may kindly be dismissed. 6. Considering that the genealogical table was prepared by Ramdhari Singh and the purchasers of land have been granted anticipatory bail in the aforesaid A.B.As. and the petitioner has got no criminal antecedent, as disclosed in paragraph 14 and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 7. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gumla in connection with Sisai P.S.
