Bail petition filed on behalf of the petitioner- Ramit Das, who is in custody since 20.06.2025 in connection with Jamtara Cyber Crime P.S. Case No. 45 of 2025 for the offence registered under Sections 111(2)(b), 317(2), 317(5), 318(4), 319(2), 336(3), 338, 340(2), 3(5) of Bhartiya Nyaya Sanhita, 2023 and Section 66(B) 66(C), 66(D) of the I.T. Act and Section 42 (3) (e) of Telecommunication Act, 2023 pending in the Court of learned Special Judge, Cyber Crime, Jamtara is pressed into motion.
As per FIR which has been lodged by the Police Inspector, Cyber Crime Police Station, Jamtara, a raid was conducted in which this petitioner along with two other accused persons were apprehended and mobile phones, SIM card, Bank Passbook, 10 ATM Cards etc. were seized from all the accused persons. 03 mobile sets, 03 ATM Cards and different active SIM cards were seized from this petitioner.
It is submitted by the learned counsel on behalf of petitioner that more than Rupees Four Lakhs were credited in the Account of the co-accused, Milan Das and he has been granted bail by the co-ordinate Bench of this Court in B.A. No.9243 of 2025. It is further submitted that only Rs.48,000/- is said to be credited in the Account of this petitioner.
Learned Special P.P. appearing on behalf of the State submits that money trail of the defrauded amount to the Account of this petitioner, has been traced during investigation. In para 83 of the case diary, victim- Lovely Kumari has stated that she had received mobile call from three different numbers, out of which one SIM Card bearing number 9204276457 was seized from this petitioner.
Under the aforesaid facts and circumstance, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the prayer for bail of the petitioner, is hereby, rejected.
