This is an application under Section 482 of BNSS, 2023 praying for grant of pre-arrest bail to the accused/petitioner, namely, Bobidul Islam who is apprehending arrest in connection with the Mukalmua P.S. Case No. 05/2026 registered under Sections 318(4)/316(2)/61(2)(b)/323/338/ Page No.# 2/2 336(3)/340(2)/111(2)(b)/111(4) of BNS, 2023 read with Sections 43/66/66(c)/66(d)/84(c) of the I. T. Act. 3. The order sheets reveal that today is the sixth occasion when the I.O. has failed to produce the case diary. 4. The learned Addl. PP submits that today a request has been received from the I.O. for further time to submit the case diary. 5. It is further submitted that the petitioner is already under arrest in connection Howly P.S. Case No. 124/2026. 6. It is submitted that the case diary was necessary for showing the petitioner as arrested in connection with the aforesaid case pertaining to Howly Police Station, but the same is not considered to be sufficient explanation for the failure of the I.O. to produce the case diary since the same was called for on 11.05.2026. 7. Having regard to the above, the interim order dated 20.07.2026 is hereby made absolute. 8. This pre-arrest bail application stands disposed of accordingly. JUDGE Comparing Assistant
