JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayers: "In Crl.P.No.6166/2026: a) Quash the Proceedings in CC No. 791/2024 pending on the file of 11th Additional Chief Metropolitan Magistrate Mayohall at Bengaluru registered for offences punishable 498-A, 323, 504, 506 R/w 34 of Indian Penal Code, 1860, and Section 4 of Dowry Prohibition Act 1961, arising out of Crime No.78/2023, produced at ANNEXURE-D; b) Pass any other Order/s or issue any Direction/s as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity. In Crl.P.No.6637/2024: A. Quash the FIR and complaint in Crime No.193/2023 dated 02-07-2023 pending on the file of Chief Metropolitan Magistrate (Transferred from 6th Additional Chief Metropolitan Magistrate Court, Bangalore) registered by the respondent police (Sadduguntepalya PS) for offences punishable under section 380 of the Indian Penal Code, 1860, produced herein at Annexures A & B respectively. B. Heard Sri. Naveed Ahmed, learned counsel appearing for the petitioners, Sri. B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri. B.A. Turki, learned counsel appearing for respondent No.2 in both the cases and have perused the materials on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed compounding applications along with the Joint Memo of Settlement. The Joint Memo of Settlement filed in both the petitions read as follows: "In Crl.P.No.6166/2026: JOINT MEMO OF SETTELMENT The above named parties most respectfully submits as under: 1. The petitioners have approached this Hon'ble Court in the above petition challenging the proceedings initiated under CC No.791/2024, pending before the learned 11 Additional Chief Metropolitan Magistrate Bengaluru, arising out of crime No. 78/2023 of East Zone Women Police Station Bengaluru, registered for offenses punishable under section 498-A, 323, 504, 506 R/w 34 of Indian Penal Code, 1860, and Section 4 of Dowry Prohibition Act 1961. 2. It is submitted that after due negotiation and on intervention of the elders of the both the families the disputes between the parties have been settled and it is agreed by the parties that they will reunite and resume their life at 1st floor of their matrimonial home. 3. That in view of the reunion of the 2nd Respondent defacto complainant don't want to prosecute the matter. It is submitted that the parties have agreed and under takes that they will withdraw all their allegation made against each other and their respective family members and hereby bond themselves that they will live happily without any quarrel and disputes with regard to the present or past proceedings if any. Wherefore in above said facts and circumstances it is prayed that this Hon'ble Court may be pleased to allow the parties to the petition to withdraw the allegations by compounding the offense in the interest of justice and equity. In Crl.P.No.6637/2024: JOINT MEMO OF SETTLEMENT The above named parties most respectfully submits as under: 1. The petitioners have approached this Hon'ble Court in the above petition challenging the complaint registered vide CR.NO.193/2023 dated 02.07.2023 pending on the file of the Chief Metropolitan Magistrate (Transferred from 6th ACMM Bengaluru) registered by the respondent police (sadduguntepalya p.s.,) for offence punishable under section 380 of Indian Penal Code, 1860. 2. It is submitted that the 2nd respondent-defacto complainant is brother in law of the petitioners herein. That sister of the petitioners had initiated criminal proceedings against the 2nd respondent which is resulted in counter case against the petitioners. The sister of the petitioners is reunited with the 2nd respondent and she has already proceeded to withdraw her case pending as cc No. 791/2024. That after due negotiation and on intervention of the elders of the both the parties have settled the disputes and it is agreed by the parties that they will withdraw all the allegations including the present proceedings and complain. 3. It is submitted that the offense under section 380 of Indian Penal Code is compoundable. That in view of the aforesaid settlement the defacto complainant-Respondent no.2 herein don't want to prosecute the matter. The trial in such circumstance would not serve any purpose. 4. It is submitted that defacto complainant-Respondent no.2 has already satisfied with his claim and don't want to prosecute the matter further. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of applications for compounding being filed along with the Joint Memo of Settlement in both the petitions and offences not being against the State, I deem it appropriate to accept the compounding applications and the Joint Memo of Settlement in both the cases and terminate the proceedings against these petitioners in the subject petitions. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petitions are disposed. ii.
