Application under Section 528 of BNSS has been filed by the applicants for quashing the chargesheet dated 09.08.2019, summoning/cognizance order dated 22.11.2019 passed in Criminal Case No. 7110 of 2019, State Vs. Ankit Mogha and Others, under Sections 170 and 171 of IPC, pending in the court of learned Additional Chief Judicial Magistrate/5th Additional Civil Judge (Sr.Div.), Rudrapur, District Udham Singh Nagar, and the entire proceedings arising out from it. 4. Learned counsel for the applicants would submit that proceedings under Section 82 Cr.P.C. have been initiated against him. Besides this, non-bailable warrants have also been issued against him in the year 2022, but, since no notices have been served upon him, therefore, he had no knowledge about the said proceedings initiated against him and only when the sureties told him about the said proceedings, he came to know about it. 5. Heard learned counsel for the parties and perused the record. 6. Having considered the submissions under the facts and circumstances of the case, proceedings under Section 82 Cr.P.C. initiated against the applicant are kept in abeyance, provided, he surrenders before the Court of learned Additional Chief Judicial Magistrate/5th Additional Civil Judge (Sr.Div.), Rudrapur, District Udham Singh Nagar on or before 06.02.2026. 7. If the applicant surrenders and moves the bail application before the court concerned, the Magistrate concerned shall consider and decide the same, in accordance with law, as expeditiously as possible. 8. It is further made clear that applicant shall provide his correct address to the Investigating Officer as well as to the Court concerned. 9.
