1. The applicants have filed the present bail applications under Section 483 of BNSS being aggrieved against the orders dated 21.07.2026 passed in Criminal Misc. Case No.389/2026 (Sher Khan v. State of Rajasthan) and order dated 16.07.2026 passed in Criminal Misc. Case No.381/2026 (Ramjan Khan & Ors. v. State of Rajasthan) by the learned Additional Sessions Judge, Sanchore, District Jalore, whereby the bail applications filed by the accused- applicants under Section 483 of B.N.S.S. were rejected. The accused-applicants are behind the bars, pursuant to the F.I.R. No.16/2026 registered at Police Station Chitalwana, District Jalore for the offences punishable under Sections 467, 468, 471, 420, 193 & 120-B of IPC.
2.
Learned counsel for the applicants submits that the offences alleged to have been committed by the applicants are triable by the Court of Magistrate and the applicants have no criminal antecedents. Learned counsel further submits that no recovery is to be made from the applicants and for the dispute in question, a civil suit has already been filed, which is pending adjudication before the court of competent jurisdiction. Learned counsel also submits that the applicants have been behind bars since 08.07.2026 and that the trial of the case is likely to take a considerable period to conclude. Learned counsel, therefore, prays that the benefit of bail may be granted to the accused-applicants. 3. Per contra, the learned Public Prosecutor as well as learned counsel for the complainant oppose the bail application and submit that the applicants had undertaken to hand over the possession of
[2026:RJ-JP:36469] (3 of 4) [CRLMB-10167/2026] the property to the complainant, however, the same has not been done. 4. Heard learned counsel for the applicants, learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record. 5. Having considered the arguments advanced by both sides and having regard to the facts and circumstances of the case, including the facts that the offences alleged to have been committed by the applicants are triable by the Court of Magistrate, the applicants have no criminal antecedents, no recovery is to be made from the applicants and for the dispute in question, a civil suit has already been filed, which is pending adjudication before the court of competent jurisdiction, and the applicants have been behind the bars since 08.07.2026, and further that the trial is likely to take a considerable amount of time, this Court, without expressing any opinion on the merits of the case, is inclined to enlarge the applicants on bail. 6.
