2. By this application, the petitioner has prayed for bail in connection with Dergaon Case No. 96/2026 registered under Sections 338/340(2)/336(3)/319(2) of the BNS,
2023. It is the case of the petitioner that an FIR was lodged on 16.05.2026, wherein it was stated that the petitioner being found in an injured condition was taken to health center and was interrogated at which he could not give any proper identity and upon verification, documents were found in his possession. The police on recovery of the document i.e. identity card of Assam Police verified the same and found that the said document was forged. It was further stated that the petitioner with the intention of cheating the public had forged the said document and had kept in his possession. 3. The learned Counsel for the petitioner further submits that the petitioner was badly hit in the motor accident on his head and he was taken from one hospital to the other for better treatment and that he was granted interim bail protection by the Court of Additional C.J.M, Golaghat by order dated 22.05.2026 and that he was under treatment but on 29.05.2026, on an application made by the Investigating Officer, the bail granted to the petitioner was cancelled. He submits that the petitioner had surrendered on 08.07.2026 in view of the said cancellation and since then he is inside the jail. 4. Mr.
D.P. Goswami, learned Additional Public Prosecutor for the State however submits that many documents were recovered from his possession and that the fake document was also found, which leads to only conclusion that the same is used to cheat the public. 5. Upon consideration of the submissions made by the learned Counsels for the parties and more so, on finding that the petitioner was arrested on suspicion after he met with an accident, this Court finds it fit to enlarge the petitioner on bail on
Page No.# 3/3 furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of CJM, Golaghat under the following conditions:
i) the petitioner will appear before the Investigating Officer as and when call for. ii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iii) the petitioner will not leave the place of jurisdiction without the permission of the said Court i.e. CJM, Golaghat. 6.
