1. The petitioner has approached this Court praying for a direction upon the concerned respondent authorities to release his arrear salary for the period between September 1, 2007 and September 30, 2010.
2. It is submitted that during pendency of the writ petition, the arrear salary of the petitioner has been released on February 9, 2024, after a long duration. The petitioner prays for interest on account of the belated payment of his arrear salary.
3. As the petitioner was entitled to receive his salary on the due date, but the same has been released after more than a decade, accordingly, he would be entitled to interest on account of such delayed payment.
4. Accordingly, the instant writ petition stands
disposed of by directing the District Inspectors of Schools (SE), Jhargram and Howrah, the third and fourth respondents herein, to calculate simple interest on account of the belated payment
of the arrear salary of the petitioner for the period mentioned hereinabove at the rate of 6% p.a. on and from the date the amount fell due till the date of actual payment and take steps for releasing the same.
5. Such payment shall be made at the earliest but positively within a period of twelve weeks from the date of communication of this order.
6. All parties are to act on the server copy of this
order duly downloaded from the official website of this Court.
7. Certified copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J]
