By way of the present petition, the petitioner seeks following prayers: “...a) Issue a Writ of Certiorari or any other appropriate writ, order or direction, thereby quashing the impugned Completion Certificate dated 02.05.2024 and letter dated 14.05.2024 issued by the Respondent no. 2, being Defamatory arbitrary, illegal and violative of Article 14 of the Constitution of India; b) Issue a Writ of Mandamus or any other appropriate writ, order or direction, thereby directing the Respondent no. 2 to release the Performance Bank Guarantee of Rs. 94,000/-, Security Deposit of Rs. 50,000/- and Contractual Dues; c) Issue an appropriate writ, order or direction directing Respondent No. 1 and Respondent No. 2 to conduct an independent inquiry into the actions of Sh. P. K. Gupta, Manager (Campus), C-DOT, who issued the purported communication dated 14.05.2024, despite the Respondents' own records disclosing that no such letter 20 is available on record , and consequently take appropriate departmental and disciplinary action against the concerned officer for issuance This is a digitally signed order. Issue notice. Mr. Udit Seth, the learned counsel accepts notice on behalf of respondent no. 2. 3. The prayer (b) of the present petition is allowed being not opposed by the other side. Accordingly, the respondent no. 2 is directed to release the Performance Bank Guarantee of Rs. 94,000/-, Security Deposit of Rs. 50,000/- and Contractual Dues within a period of four weeks from date. 4. As regards prayers (a) and (c) are concerned, the same have not been pressed, as the agreement entered into between the parties contains an Arbitration Clause i.e. Clause 1.23 of the Centre for Development of Telematics Agreement. 5. In view of the above directions, the present petition stands disposed of. 6. The order be uploaded on the website forthwith. DR.
