Also heard the learned Addl. Public Prosecutor for the State of Assam. Notice on respondent No. 2 is complete but none appears. This I.A has been preferred seeking condonation of a delay of 338 days in preferring the connected criminal revision petition. The reason for the delay is stated to be the medical as well as financial condition of the petitioner, wherein it is stated that he was suffering from cardiac disease, diabetes and Page No.# 3/3 hypertension, and was undergoing constraint medical treatment and medication. Due to the expenses incurred towards such treatment and his financial constraints, he had to borrow money to file the present revision. Having regard to the cause shown and since no objection has been filed, this Court deems it fit to condone the delay in preferring the connected criminal revision petition.
