The present appeal arises out of the judgment and order dated 17.06.2022 passed by the learned Single Judge in WP(C) No. 87/2018, whereby the learned Single Judge directed the Deputy Commissioner/collector to calculate the statutory benefits under LA Award No.1/2009 and forward the same to the acquiring authorities for release of the entire awarded compensation together with admissible solatium and interest to the landlords. 2. The facts are not in dispute. The respondents /writ petitioners are landowners, whose land situated in Silgur-II, Nunsuri, Bindasora, Tablabagh, Malsury and Devasora villages in Lunglei district was acquired for construction of Indo-Bangladesh border fencing. 3. Notification under Section 4 of the Land Acquisition Act, 1894 was issued on 06.11.2006 pursuant to which the Collector prepared draft Award No. 1/2009 determining the compensation. The draft award received the approval of the Government of Mizoram on 08.05.2009, under the first proviso to Section 11(1) of the Act, 1894, and thereafter, the Award was forwarded to the acquiring agency for deposit of the awarded amount. 4. Since the awarded compensation was not released, proceedings were initiated before the Reference Court seeking statutory benefits under the Land Acquisition Act. Although the Reference Court initially granted solatium and statutory interest, the matter was subsequently remanded by a Single Judge in WP(C) No. 2/2015 on the ground that the acquiring agency had not been impleaded in the proceeding. Upon remand, the reference proceeding ultimately came to be dismissed primarily for the reason that the Reference did not have any authority to determine the dispute raised. Page No.# 46/52 5. Thereafter, the respondent instituted WP(C) No. 87/ 2018 seeking a direction for payment of the compensation determined under Award No. 1/2009 together with solatium, statutory interest under section 23 (1)(A) and 23 (2) and interest for delayed payment under Section 28 and 34 of the Land Acquisition Act, 1894. 6. The learned Single Judge, under the impugned judgment, held that the Collector's award had never been challenged in any proceeding known to law. Relying upon the decisions of the Honourable Apex Court in Union of India and Another vs Pushpavathi and Others reported in (2018) 3 SCC 28 and Santosh Kumar and Ors. vs Central Warehousing Corporation and Another reported in (1986) 2 SCC 343, the learned Judge concluded that the writ petition was maintainable for enforcement of statutory entitlement arising from the Award. 7. Accordingly, the Deputy Commissioner was directed to calculate the statutory benefits and forward the same to the acquiring authorities for release of the entire awarded compensation together with admissible solatium and interest to the landlords. 8. Mr Phukan, learned counsel for the Appellants, assailing such determination, contended that the writ petition ought to have been dismissed solely on the ground of unexplained delay and laches, as the respondents approached the writ court nearly nine years after passing of the award. It was submitted that respondents had an efficacious statutory remedy by way of execution of the award and therefore, invocation of extraordinary jurisdiction under Article 226 was wholly unwarranted. 9. Reliance was placed on State of MP & Ors. v. Nandlal Jaiswal, and Ors., reported in (1986) 4 SCC 566, and Chennai Metropolitan Water Supply and Sewerage Board & Ors. T.T. Murali Babu reported in (2014) 4 SCC 108 to contend that stale claims should not be entertained in exercise of discretionary jurisdiction. 10. It was further argued that the award passed by the Collector was executable as a decree and that the High Court ought not to assume the role of an executing Page No.# 47/52 court. Reliance in this regard was placed upon Rampal Jadhav and Another vs. State of Haryana and Others reported in 2021 SCC OnLine P&H 3358, Banamali Katu and Ors. vs The State and Others reported in 2000 SCC OnLine Cal 570 and B. Govinda Reddy vs Revenue Divisional Officer -cum- Land Acquisition Officer, Kurnool, reported in 1997 SCC OnLine AP 602. 11. Placing reliance upon Executive Engineer, Nimna Dudhna Project, Selu, District Parbhani, Maharashtra vs State of Maharashtra reported in (2020) 3 SCC 255, it was also argued that interest ought not to be awarded for the period attributable to the respondents' own delay in approaching the court. 12. An additional contention advanced by the appellants was that they had no knowledge of the award and that certain factual irregularities relating to the acquisition process, including excess acquisition of land, had escaped consideration of the Collector as well as of the learned Single Judge. It was therefore submitted that the learned Single Judge proceeded on equitable considerations without appreciating the factual and legal objections raised by the appellants. 13. Per contra, Mr C. Lalramzauva, learned Senior Counsel appearing for the respondents, submitted that the writ petitioners did not seek enhancement of compensation nor did they question the acquisition proceeding. The limited grievance was that statutory benefits already determined under the Land Acquisition Act had been unlawfully withheld. 14. It was argued that payment of solatium and statutory interest is not a matter of discretion but a statutory obligation. Failure to discharge such obligation gives right to a continuing cause of action amenable to correction under Article 226 of the Constitution. 15. Reliance was placed upon the decision of a co-ordinate bench in Young Lai Association (YLA) & Anr vs State of Mizoram & Ors reported in 2017 (3) GLT 382, the decision of the Supreme Court in Vidya Devi vs State of Himachal Pradesh and Page No.# 48/52 Others reported in (2020) 2 SCC 569 and Ultra-Tech Cement Limited vs Mast Ram and Others reported in (2025) 1 SCC 798 to contend that Constitutional guarantee under Article 300A obligates the State and its instrumentalities to pay lawful compensation together with all statutory incidents attached to it and that technical objections relating to delay or alternative remedy cannot defeat an admitted statutory entitlement. 16. We have bestowed our anxious consideration to the rival submissions and carefully examined the records of the case. The principal objection raised by the appellant is that the writ petition itself ought not to have been entertained on account of unexplained delay of almost nine years and that respondents, if at all aggrieved, ought to have sought execution of the award instead of invoking the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India. The appellants have also attempted to question the award itself by contending that they had no knowledge of the award and that the award suffered from several infirmities. 17. In our considered opinion, none of the aforesaid contentions merit acceptance. 18. At the outset, it deserves to be noticed that acquisition proceedings themselves are not in dispute. The lands of the respondents stood acquired for the benefit of the appellant. The statutory procedure contemplated under the Land Acquisition Act, 1894 culminated in the preparation of a draft award by the Collector, which the Government thereafter approved. Upon such approval, the award attained finality. Admittedly, the award was never challenged by the appellant before any competent forum. 19. The legality and validity or correctness of the award, therefore, cannot now be permitted to be questioned collaterally in a proceeding initiated by the land owners only for enforcement of the statutory consequences following the award. 20. The plea that the appellant had no knowledge of the award is equally devoid of merit. Page No.# 49/52 The acquisition itself was undertaken exclusively for the benefit of the appellant. The statutory scheme required Governmental approval before the award could attain finality. It is, therefore, difficult to accept that the beneficiary of the acquisition remained completely unaware of the very award determining the compensation payable. Significantly, except for making a bold assertion, no contemporaneous material has been produced to establish either the absence of knowledge or the date on which such knowledge was allegedly acquired. Even thereafter, no proceedings were instituted to date challenging the award. The conduct of the appellant is thus wholly inconsistent with the plea now sought to be advanced. 21. Once the award attained finality, the acquiring authority and the beneficiary cannot selectively accept part of the award which suits them while refusing to discharge the statutory liabilities imposed by the very same award. Such a course would strike at the finality attached to the statutory adjudication under the Land Acquisition Act. 22. The next submission relates to the delay and laches. There can be no dispute with the proposition laid down in Nandlal Jaiswal (supra) and Chennai Metropolitan Water Supply and Sewerage Board (supra) that the writ jurisdiction is discretionary and stale claims ordinarily ought not to be entertained. Those decisions, however, were rendered in entirely different factual settings and cannot be applied divorced from the nature of the right sought to be enforced in the writ petition. 23. In the present case, the respondents are not seeking enhancement of the compensation nor are they questioning the acquisition proceedings. The award has already determined the compensation payable. The grievance of the respondents is confined to non-payment of statutory benefits which automatically flow from the award under the provisions of the Land Acquisition Act, 1894. Failure to discharge such statutory obligation gives rise to a continuing cause of action. Page No.# 50/52 24. Mere lapse of time, therefore, cannot extinguish a liability imposed by statute, more particularly in the absence of any such statutory prescription. 25. The constitutional dimension of the controversy cannot also be overlooked. Article 300A mandates that no person shall be deprived of his property save by authority of law. Lawful acquisition necessarily carries with it a corresponding obligation to pay lawful compensation together with all statutory incidents attached thereto. The Supreme Court in Vidya Devi (supra) empathetically reiterated that the State cannot retain private property without paying due compensation. More recently, in Ultra-Tech Cement Limited (supra), the Supreme Court observed that once the land is acquired under the power of eminent domain, the acquiring authority is under a bounden statutory obligation to ensure prompt payment of compensation to the landowners. The Court further deprecated attempts by acquiring authorities to avoid or delay discharge of such statutory obligations. 26. Equally unsustainable is the submission that respondents ought to have pursued execution proceedings instead of invoking Article 226. Availability of alternative remedy undoubtedly remains an important consideration governing exercise of writ jurisdiction. However, it is equally well settled that such remedy is not an inflexible bar where enforcement of an undisputed statutory obligation is involved. 27. The respondents have not sought adjudication of disputed private rights. The entitlement flows directly from a statutory award which has attained finality. The Coordinate Bench decision in Young Lai Association (supra) correctly recognised that in appropriate cases involving enforcement of statutory compensation arising out of compulsory acquisition, exercise of writ jurisdiction cannot be declined merely because another remedy may also be available. 28. We are also unable to accept the attempt made by the appellants to assail the Page No.# 51/52 correctness of the award by alleging excess acquisition or procedural irregularities. Such issue, even if assumed to exist, could only have been raised by instituting appropriate proceedings questioning the award itself. The award having attained finality long ago, such objections cannot be re-agitated indirectly while resisting payment of statutory benefits. Permitting such collateral challenge would defeat the entire statutory framework governing land acquisition and unsettle concluded proceedings. 29. Reliance has also been placed by the appellant upon Executive Engineer, Nimna Dudhna Project (supra) to contend that interest ought not to be granted for the period attributable to the respondent's delay. 30. The principle enunciated therein is well settled. Interest being compensatory in nature may in any appropriate case be regulated having regard to the conduct of the claimant. However, that principle cannot be stretched to deny the substantive statutory benefits themselves. The liability to pay compensation, together with the statutory incidence attached to the award, remains unaffected. At best, the question regarding computation of interest, in a given case, for any identifiable period attributable solely to the beneficiary of an Award may be examined while implementing the award, if the fact so justifies; it does not furnish a ground to interfere with the judgment under appeal. 31. Viewed from any angle, we find ourselves in agreement with the conclusion reached by the learned single judge that the respondents cannot be deprived of statutory benefits attached to an award which has attained finality and has never been questioned in accordance with law. The objections founded upon delay, alternative remedy, alleged lack of knowledge and collateral challenge to the award do not persuade us to take a different view. Page No.# 52/52 The opinion rendered by the learned single judge can neither be termed as perverse, nor is the decision rendered ignoring any settled principle of law, warranting interference at the hands of an intra-court appellate forum. 32. We accordingly find no error either in law or on facts warranting interference with the impugned judgment. The appeal being devoid of merit deserves dismissal.
