Matter comes up on interim application No.02/2026 in S.B. Civil Writ Petition No.16221/2019 submitted by the respondent No.3 for dismissing the instant petitions as the same have become infructuous in light of the judgment passed by the Hon'ble Apex Court in the case of Mrinmoy Maity vs. Chhanda Koley and Others while deciding Special Leave Petition (Civil) No.30152/2018. 2. Learned counsel for the respondents submits that when the matter was listed before this Court on the last occasion i.e. on 05.07.2022, this Court deferred the matter only on the ground that the issue involved in these petitions is pending before the Hon'ble Apex Court in the case of Mrinmoy Maity (supra). Counsel submits that now the Hon'ble Apex Court has dismissed the aforesaid SLP (Civil) No.30152/2018 vide order dated 18.04.2024. Hence, the issue involved in the instant petitions has already been set at rest and nothing more is required to be adjudicated. 3. Per contra, learned counsel appearing on behalf of the petitioner opposed the prayer, but he is not in a position to controvert the aforesaid submission. Considering the arguments put forward by learned counsels for the parties and looking to the fact that the issue involved in these petitions has already been set at rest by the Hon'ble Apex Court in the case of Mrinmoy Maity (supra), this Court find no reason to take a different view. 5.
