THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE ALAPATI GIRIDHAR CONTEMPT CASE NOS: 191 & 221 OF 2026 COMMON ORDER: (per Ravi Nath Tilhari, J)
Heard Sri K.S.Murthy, learned senior counsel assisted by Sri M.Atchyut, learned counsel for the petitioners and Sri K.Dilip Naik,
learned counsel for the respondents.
2. The above two Contempt Cases have been filed alleging wilful disobedience of the judgment and order dated 07.04.2025 passed in W.A.Nos.31 & 45 of 2025 respectively.
3. The writ appeals were filed challenging the order of learned Single Judge in W.P.Nos.988 of 2018 & 24887 of 2014 decided on 02.12.2022.
4. Learned Single Judge in the writ petitions directed for payment of compensation with respect to the trees under old notification vide Gazette No.27/TGP/91, dated 12.08.1991.
5. The judgment was modified in writ appeals in the following terms:
“15. Accordingly the writ appeals are partly allowed affirming the judgment of the learned Single Judge, subject to the modification of the orders of the learned Single Judge to the extent of holding that compensation in relation to the trees, found on the land of the petitioner, in the notification issued in 1991, and the Award passed in 1994, would have to be paid in terms of the Land Acquisition Act, 2013.”
5
6. Learned senior counsel for the petitioners submits that when the previous notification under Section 4 of the Land Acquisition Act was issued in the year 1991 also with respect to the petitioners’ land for acquisition that the trees were shown. So land was to be acquired with trees. However that notification lapsed and a fresh notification was issued in the year 2014 under the New Act 30 of 2013 but this time only land was shown and not the trees. Consequently, the writ was filed in which learned Single Judge passed the order dated 02.12.2022, which was modified in the appeals on 07.04.2025 as referred to above. There is no dispute with respect to the compensation for the land, for which the award had already been passed.
7. The counter has been filed by respondent No.2 stating in para-8 that fresh award dated 27.05.2026 has been passed with respect to the trees; for the petitioners, as per Section 26 of the RFCTLARR Act, 2013, as per the market value, taking into consideration the relevant factors.
8. Learned senior counsel for the petitioners submits that though the award has been passed as aforesaid, but the determination of compensation for the trees is not in accordance with law under the Right to Fair Compensation and transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
6
9.
Learned counsel for the respondents submits that the Special Deputy Collector – respondent No.3 has made determination with respect to the trees in terms of the order passed by the learned Single Judge in W.P.Nos.988 of 2018 & 24887 of 2014 as modified by the Division Bench in W.A.Nos.31 & 45 of 2025 under the New Act 30 of
2013.
10. We are of the view that so far as the contempt matters are concerned, since the awards have been passed referring to Act 30 of 2013 it cannot be said that there is wilful disobedience or contempt of the orders passed in Writ Appeals.
11. If there is any grievance left to the petitioners with respect to the awards, the amount of compensation, the petitioners are at liberty to seek appropriate remedy as may be open to them in the law.
12. Learned senior counsel for the petitioners further submits that no payment has been made even as per the award now passed. If it be so, the petitioner may approach the competent authority for redressal of such grievance, who shall look into such grievance.
13. With the aforesaid observations, the Contempt Cases are rejected.
No order as to costs.
7
As a sequel thereto, miscellaneous petitions, if any pending, shall also stand closed. ____________________ RAVI NATH TILHARI,J
