JUSTICE K.MANMADHA RAO - 3 - HC-KAR NC: 2026:KHC:15719 WP No. 8681 of 2026 ORAL ORDER Heard Sri. N. Gowtham Raghunath, learned counsel for the petitioner. 2. This writ petition is filed seeking a direction to the Court of VI Additional Family Judge, Bengaluru (hereinafter referred to as the ‘Family Court’) to dispose of M.C.No.488/2021 which is pending on its file time bound. 3. Learned counsel for the petitioner submits that petitioner is the husband of the respondent. The petitioner filed M.C.No.488/2021 seeking to declare the petitioner's marriage with the respondent be declared as null and void under Section 12(1)(b) read with Section 5 (ii)(b) and 5 (ii)(c) of the Hindu Marriage Act, 1955. The petitioner and respondent addressed their arguments on IA.5 which is filed by the respondent to direct the petitioner to produce documents ie., bank statement and income tax return and thereafter matter was posted on 12.06.2025 for orders on IA. Till today, the Family Court has not passed orders on - 4 - HC-KAR NC: 2026:KHC:15719 WP No. 8681 of 2026 IA. This delay has not only delayed the adjudication of IA but also the adjudication of the main matter wherein Trial is yet to be commenced. Aggrieved by the same, this writ petition is filed. 4. Record discloses justification in the submission that is made by learned counsel for the petitioner. Therefore, this Court considers desirable to dispose of the writ petition and give directions. Hence, the following: ORDER (i) Writ petition is disposed of. (ii) The Court of VI Additional Principal Judge, Family Court, Bengaluru is directed to take all steps for disposal of MC No.488/2021 as expeditiously as possible. (iii) This Court is not issuing the notice to the respondent as no adverse orders are passed and disposed of the petition in the interest of both the parties. - 5 - HC-KAR NC: 2026:KHC:15719 WP No. 8681 of 2026 (iv) As the writ petition is disposed of without notice to the respondent, Family Court is directed to serve copy of this order to the respondent so as to give notice to the respondent, about filing of this petition and its disposal.
