This is First anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.170/2025 registered at Police Station – Gidhauri, District – Baloda Bazar-Bhatapara (C.G.) for the offence punishable under Section 318 (4), 3(5), 111 of BNS. 2. Prosecution case in brief is that the complainant Deepak Kumar Dansena lodged the written complaint stating that the main accused Ramnarayan Sahu has received the amount Rs. 1,58,45,000/- from VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.03.19 10:50:59 +0530 2 the complainant and Rs. 93,10,000/- from his friend Vijay Kumar Sharma in his account and the account of the other co-accused and gave the assurance that he will invest the amount in the Share Market and the amount will be doubled in further 25 months. That Deepak Dansena, Vijay Kumar Sharma through Aatmaram Sahu gave total amount of Rs. 2,53,55,000/- for the scheme to Ramnarayan Sahu. That on the assurance of the accused Ramnarayan Sahu, the complainant has received the amount from his family members & friends and gave it to the accused Ramnarayan Sahu but he failed to return the amount and the main accused Ramnarayan Sahu has committed fraud with him. 3. Learned counsel for the applicant would submit that the applicant is innocent person and he has not committed any offence as alleged by the prosecution and he is falsely implicated in the present case. It is further submitted that four co-accused persons have already been granted regular bail by this Court and one other co-accused, namely Sampat Kumar Sahu has been granted anticipatory bail by this Court in MCRCA No.226 of 2026 vide order dated 27.02.2026, therefore, he prays for grant of anticipatory bail to the present applicant on the ground of parity. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail to the applicant. 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering the facts & circumstances of the case, submissions of learned counsel for the parties, and further the fact that four co- accused persons have already been granted regular bail by this Court 3 and one other co-accused has been granted anticipatory bail by this Court in MCRCA No.226 of 2026 vide order dated 27.02.2026, therefore, I am inclined to extent the benefit of Section 482 of the B.N.S.S. to the applicant on the ground of parity. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Tulsinand Sahu, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
