JUSTICE P SREE SUDHA ORAL ORDER Heard the arguments on both sides. 2. This petition is filed by the wife for transfer of M.C. No.90/2019, pending on the file of the Senior Civil Judge and J.M.F.C., Arasikere to the Principal Family Judge at Shivamogga and also M.C. No. 15/2019 filed for divorce by her husband. 3. It is stated by the respondent's counsel that previously M.C.No.15/ 2019 was transferred from Bengaluru to Arasikere as she was residing there. The counsel for the petitioner stated that recently she got job in Shivamogga and shifted there along with her daughter and also admitted her daughter in the school and the distance between Shivamogga and Arasikere is about 120 kilometers and now she requested for transfer of both the matters to Arasikere to defend properly. - 3 - HC-KAR NC: 2026:KHC:11992 CP No. 72 of 2026 4. Learned counsel for the respondent stated that both the matters are posted for arguments and also filed a case status report to substantiate his version and apart from that, he filed the directions given by this Court to dispose of M.C. No. 15/2021 within 3 months from the date of receipt of copy of this order. It is stated that both the matters are pending before the same judge, for the reasons best known to the trial Court, they were not clubbed together. Evidence is completed in both the matters and they are posted for arguments. 5. Therefore, the trial Court is specifically directed to club both the matters and to dispose of them at a time to avoid conflicting of judgments and as the cases are at the stage of arguments, merely because it is inconvenient for the petitioner, they cannot be transferred. She is at liberty to engage another counsel of her choice or she can apply leave and argue the matter in person if at all she intended to advance arguments in person. - 4 - HC-KAR NC: 2026:KHC:11992 CP No. 72 of 2026 With the above observations, the petition is dismissed.
