This bail application has been filed on behalf of Kundan Yadav @ Baban Yadav who is in custody since 19.03.2025 in connection with Mohanpur P.S. Case No. 72 of 2025 for the offence registered under Sections 191(2), 191(3), 126(2), 115(2), 118(1), 118(2), 109, 352, 351(2) of the BNS, 2023 pending in the Court of Sub-Divisional Judicial Magistrate, Deoghar, is pressed into motion. As per the F.I.R., on 24.02.2025 petitioner had earlier molested the granddaughter of the informant regarding which Mohanpur P.S. Case No. 53 of 2025 was lodged against him. With this enmity, the petitioner along with the four other co-accused persons conjointly assaulted the deceased-Haldar Yadav resulting in his death. It is submitted by the learned counsel on behalf of petitioner that the prosecution has set up a highly improbable case of assault against this petitioner, wherein it has been stated that the weapon of offence was given by Dublal Yadav to him i.e., axe by which he inflicted fatal blow on the deceased-Haldar Yadav. Petitioner is in custody for 10 months. Learned A.P.P. for the State assisted by counsel on behalf of the informant opposed the prayer for bail and submitted that his name is in the FIR and there is direct and specific allegation of inflicting fatal blow on this petitioner. 2026:JHHC:2962 Petitioner is the principal accused in the present case, and in the earlier case of molestation.
