Heard Mr. P.K. Munir, learned counsel for the applicants and Mr. P.S. Lahkar, learned Additional Public Prosecutor for the State respondent.
2. Apprehending arrest in connection with Patacharkuchi P.S. Case No. 50/2026, under Sections 329(4)/115(2)/76/109/118(2)/303(2)/3(5) of the BNS, 2023, this application under Section 482, BNSS is preferred by five applicants, namely, Ful Khatun @ Moiful Nessa, Ishmitara Khatun @ Ishmitara Parbin, Muhur Uddin, Jahidul Islam and Aijul Haque @ Ajijul Haque, for grant of pre- arrest bail.
3. Mr. Lahkar, learned Additional Public Prosecutor for the State respondent has apprised this Court that in this case, scanned of copy of the record from the learned trial Court was called for as charge-sheet had been submitted and the same has been received, and on perusal of the same, it appears that charge- sheet has been submitted under Sections 329(4)/115(2)/117(2)/76/303(2)/3(5)
Page No.# 3/3 of the BNS, 2023, and all these Sections are bailable, and in that view of the matter, this application becomes infructuous as the apprehension of arrest ceased to exist.
4. Accordingly, taking note of the submission of Mr. Lahkar and also considering the scanned copy of the record, this application stands closed, as it becomes infructuous as apprehension of arrest now ceased to exist.
