By way of instant application, prayer has been made by the applicant/Decree Holder to modify order dated 23.03.2026 passed in OMP No.105 of 2025 in Execution Petition No.7 of 2024, whereby direction came to be issued to release the amount in terms of order dated 30.12.2025 in favour of the Punjab National Bank, Uttam Bhawan, Near 103 Tunnel, Shimla by remitting the same in its account. Mr. S.D. Vasudeva, learned Deputy Advocate General, who has put in appearance on behalf of the non- applicants/respondents-State, fairly states that he does not intend to file reply and this Court may pass appropriate orders. It has been averred in the application that money, which was ordered to be deposited in favour of the Punjab National Bank, Uttam Bhawan, Near 103 Tunnel, Shimla, is required to be released in favour of Punjab National Bank, Mall Branch, Shimla, in terms of email dated 24.04.2026 (Annexure A colly) (available at page 109 of the paper book). Since the amount ordered to be released shall remain deposited with Punjab National Bank itself, albeit in its Mall Branch, no prejudice would be caused to either of the parties in case prayer made by the applicant/DH for modification of order dated 23.03.2026 is accepted and accordingly, the application is allowed and order dated 23.03.2026 is modified to the extent that amount, in terms of order dated 30.12.2025, shall be released in favour of the Punjab National Bank, Mall branch, Shimla, by remitting the same in its account, detail whereof shall be furnished by the learned counsel for the applicant/DH within two days.
