JUSTICE S RACHAIAH - 3 - HC-KAR NC: 2026:KHC:13086 CRL.P No. 17541 of 2025 ORAL ORDER This petition is filed by accused seeking anticipatory bail in Crime No.379/2025, registered by Anekal police station, Bengaluru for the offences punishable under Sections 192(A) of Karnataka Land Revenue Act, 1964 and Sections 316(4), 336(3), 318(4), 336(2), 340(2) r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023. Brief facts of the case: 2. It is the case of prosecution that, a complaint came to be registered by the complainant/Thasildar Grade - II stating that the petitioner and others were working in his office under different designations. It is alleged that petitioner and others, in order to facilitate the land grabbers, made wrong entries in the revenue records and also fabricating some documents. The said aspect has been proved on enquiry. Therefore, the complaint came to be registered against the petitioner and others. Based on the said complaint, the respondent - police have registered a case. - 4 - HC-KAR NC: 2026:KHC:13086 CRL.P No. 17541 of 2025 3. Heard Sri. B.M.Lokesh, learned counsel for the petitioner and Sri. B. Laxman, learned High Court Government Pleader for the respondent - State. 4. The learned counsel for the petitioner submits that there are omnibus allegations made against the petitioner and others. No specific overt act is attributed against the petitioner to invoke the aforesaid provisions. The petitioner is innocent of alleged offences. She is working as a Village Accountant. The allegations are baseless and bald. In fact, the similarly placed other accused have already been enlarged on bail by the Co-ordinate Bench of this Court. Hence, the petitioner may be enlarged on bail by imposing suitable conditions and she will abide by the conditions imposed by this Court in the event of release on bail. Making such submissions, learned counsel for the petitioner prays to allow the petition. 5. Per contra, learned High Court Government Pleader for respondent - State vehemently submits that the petitioner is seeking for anticipatory bail. The custodial interrogation is very much essential in order to unearth the scandal or scam that had taken place in the office of Tahsildar at Anekal. If the - 5 - HC-KAR NC: 2026:KHC:13086 CRL.P No. 17541 of 2025 petition is allowed, the fair investigation may not be possible. Hence, the petition has to be rejected and allow the Investigating Officer to conduct fair and proper investigation. Making such submissions, the learned High Court Government Pleader prays to dismiss the petition. 6. Having heard learned counsel for the respective parties and on perusal of the averments of the complaint, no doubt, the complainant has made omnibus allegations against all the officials working under him in his office. It is also noticed that, similarly placed other accused persons have been enlarged on bail by the Co-ordinate Bench of this Court. If suitable conditions are imposed, it would satisfy the requirement of investigation. 7. Hence, I proceed to pass the following: ORDER i. The criminal petition is allowed. ii. The petitioner is ordered to be enlarged on bail in the event of her arrest in Crime No.379/2025 of respondent - police, for the aforesaid offences, on executing personal bond for a sum - 6 - HC-KAR NC: 2026:KHC:13086 CRL.P No. 17541 of 2025 of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like sum to the satisfaction of the Trial Court. iii. The petitioner shall appear before the jurisdictional police within a period of one month from today to execute personal bond and also to furnish surety. iv. The petitioner shall not threaten or tamper the prosecution witnesses. v. The petitioner shall appear before the Trial Court on all hearing dates without fail. In case, if the petitioner violates any of the bail conditions as stated above, liberty is reserved to the prosecution to file necessary application for cancellation of bail.
