The instant second bail application has been filed by the petitioner under Section 483 BNSS who has been arrested in connection with the FIR No.89/2025 dated 06.02.2025 registered at the Police Station Pratap Nagar (Udaipur), District Udaipur, for the offences under Sections 103(1) and 3(5) of BNS. 2. Learned counsel for the petitioner submits that the first bail application of the petitioner was dismissed as withdrawn with liberty to renew the prayer after the statement of Investigating Officer. He submits that now the statement of Investigating Officer (PW/3) has been recorded, therefore the instant second bail application has been filed. 3. Learned counsel for the petitioner further submits that the petitioner has been falsely implicated in the case on the basis of circumstantial evidence, as there is no eyewitness to the incident, nor is the prosecution able to arrive at a definite conclusion on the [2026:RJ-JP:38142] (2 of 3) [CRLMB-1541/2026] basis of which the petitioner can be said to be involved in or to have committed the crime in question. He submits that the petitioner has no criminal antecedents and that out of 24 witnesses, only 8 have been examined so far. He further submits that the case of the petitioner is similarly situated to the case of co-accused Kamlesh @ Ajeet, who was enlarged on bail on 22.07.2026 by a Coordinate Bench of this Court in S.B. Criminal Misc. Bail Application No. 2239/2026. Therefore, the petitioner deserves to be enlarged on bail. 4. Per contra, learned Public Prosecutor opposed the bail application; however, he is not in a position to refute the fact that the case of the petitioner is similarly situated to the case of co- accused Kamlesh @ Ajeet, who has already been enlarged on bail on 22.07.2026. 5. Having considered the submissions advanced at Bar by learned counsel for the parties and having regard to the entirety of facts and circumstances of the case as available on record; and looking to the fact that trial may take a long time to conclude and, without expressing any opinion on the merits/demerits of the case, this Court deems it fit to enlarge the petitioner on bail. 6. Consequently, the instant bail application is allowed. It is ordered that the accused petitioner Shyam Lal S/o Puna Lal, arrested in connection with FIR No.89/2025 dated 06.02.2025 registered at the Police Station Pratap Nagar (Udaipur), District Udaipur, shall be released on bail; provided that he furnishes a personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court, with [2026:RJ-JP:38142] (3 of 3) [CRLMB-1541/2026] a stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
