Page No.# 2/3 This is an application under Section 482 of the BNSS, 2023 for grant of pre- arrest bail to the petitioner, namely, Abhinash lal Baishy, in connection with CID Cyber Police Station Case No. 06/2026, under Sections 77/78/351(2)/356(2) of BNS, 2023 read with Section 66E/67/67A of the Information Technology Act,
2000. The allegation against the petitioner relates to the circulation of a video of the victim on the social media. Learned Addl. Public Prosecutor submits, with reference to the CD, and that the petitioner has admitted before the I.O about his involvement. It appears from the material available in the CD that the petitioner and the victim were in a love relationship, which is recorded in the FIR as well. Due to certain differences that developed between them, the petitioner had resorted to the aforesaid act out of anger. The petitioner is a 21-year-old student. Learned Addl. Public Prosecutor submits that from the CD, it appears that the petitioner admitted to his involvement. Pursuant to the interim protection granted by this Court, the petitioner appeared before the I.O., and his statement has been recorded.
Page No.# 3/3 In view of the above, the custodial interrogation of the petitioner may not be necessary. Accordingly, the interim order dated 26.06.2026 is hereby made absolute. It is further provided that the petitioner shall not try to intimidate or influence the victim or the witnesses in any manner. The petition stands disposed of accordingly.
