INDIRESH - 3 - HC-KAR NC: 2026:KHC:18430 CMP NO.598 OF 2025 ORAL ORDER In this petition, the petitioner is seeking an appointment of sole Arbitrator to adjudicate the dispute between the petitioner and respondents as per Clause 14.17 of the Agreements for Sale dated 15th June, 2024 which were registered on 26th August, 2024 vide Annexures 'H' and 'J'. 2. Heard Sri. Shravan S. Lokre, learned counsel appearing for the petitioner and Sri. Prashanth M.V., learned counsel appearing for respondents. 3. Having taken note of the submission made by learned counsel appearing for the parties, I have carefully perused Clause 14.17 of the Agreements for Sale dated 15th June, 2024 registered on 26th August, 2024 (Annexures 'H' and 'J'), which provides for resolution of dispute between the parties through an Arbitration. In that view of the matter, I am of the view that, a former judge of this Court be appointed as Arbitrator to resolve the dispute between the parties. 4. Therefore, Hon'ble Mr. Justice P.N. Desai, Former Judge of this Court is appointed as an Arbitrator to resolve the dispute between the parties in the Arbitration and Conciliation - 4 - HC-KAR NC: 2026:KHC:18430 CMP NO.598 OF 2025 Centre (Domestic and International), Bengaluru. In order to avoid further delay in the matter, parties are directed to appear before the Arbitration and Conciliation Centre (Domestic and International), Bengaluru on 28th April, 2026 at 11.00 a.m. 5. All claims and contentions of the parties are kept open to be decided by the Arbitral Tribunal. 6. A copy of this order be sent forthwith to the Arbitration and Conciliation Centre (Domestic and International), Khanija Bhavan, Bengaluru for proceeding further in the matter. 7. Registry is directed to return the original documents if any, produced by the parties, after obtaining photostat copy of the same for the file.
