Order on Board 06.02.2026
1. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of regular bail, as he has been arrested in connection with Crime No. 561/2025, registered at Police Station
2 Takhatpur, District Bilaspur (CG) for the offence punishable under Sections 296, 351(2), 115(2), 190, 191(1), 118, 109(1) of BNS.
2. The prosecution story in brief, is that on the complaint lodged by Savita Shukla on 04.10.2025, it was alleged that on 03.10.2025 at about 10:00 P.M., while she was at her house, her husband Manish Shukla had returned home from Lormi with the children and was talking on his mobile phone outside the house. At that time, accused Krishna Sahu, Mahendra Rajput and other co- accused arrived near the house on motorcycles and, due to previous enmity, abused Manish Shukla in filthy language and threatened to kill him. The accused persons then assaulted him with fists and blows, during which Krishna Sahu struck Manish Shukla on the head with an iron rod, and Mahendra Rajput assaulted him with a stick, after which they fled from the spot. It is further alleged that when Suryakant Rajput was informed about the incident and reached near the house of Krishna Sahu, the accused persons again assaulted him with an iron rod and stick. When Gokul Rajput and Uttam Rajput intervened to rescue him, they were also beaten by the accused persons with rods and sticks. All the injured persons sustained serious injuries and were admitted to the hospital for treatment.
3. On the basis of the said complaint, Crime No. 561/2025 was registered at Outpost Junapara, Police Station Takhatpur, District Bilaspur under Sections 296, 351(2), 115(2), 190, 191(1), 118 and
3 109(1) of the Bharatiya Nyaya Sanhita. During investigation, medical reports revealed that the injuries to the victims were of grievous nature, and in the absence of timely medical treatment, the injuries could have been fatal. Accordingly, the accused persons were arrested. Hence, the bail application.
4.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submit that due to political vendetta, the present applicant has been falsely implicated by the motivated police. The FIR itself clearly attributes the assault to Krishna Sahu and Mahendra Rajput, from whose possession the iron rod and stick were seized, whereas nothing has been recovered from the present applicant, clearly showing her false implication. He also submits that the applicant has been in judicial custody since 24.10.2025 merely on suspicion, which, however strong, cannot take the place of legal proof. The name of the applicant does not find mention in the FIR, and she has been roped in only on the basis of a memorandum statement, which is unreliable and insufficient to establish her involvement. He later submits that the allegations levelled against the applicant are false, baseless and not worthy of reliance, as no prima facie case is made out against him. The applicant is a respectable person of the locality and has been made a scapegoat by the prosecution agency. Considering that the trial is likely to take a long time, the applicant’s liberty
4 deserves protection to prevent her harassment and unjustified detention on the basis of a mala fide and tainted action by the police. Therefore, he prays for grant of bail to the applicant. 5. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. He further submits that the applicant along with other co-accused persons participated in the assault on Manish Shukla, Suryakant Rajput, Gokul Rajput and Uttam Rajput by abusing them, threatening to kill them, and causing injuries with iron rod and stick, and as per MLC report, the injuries are found to be grievous in nature. Therefore, the applicant is not entitled for grant of bail. 6. I have heard learned counsel for the parties and perused the case diary. 7.
From perusal of the impugned order and case diary, it prima facie appears that on 03.10.2025 at about 10:00 P.M., the applicant, along with co-accused Krishna Sahu, Mahendra Rajput and others, reached near the house of Manish Shukla on motorcycles and, due to previous enmity, abused him in filthy language and threatened to kill him, the accused persons collectively assaulted Manish Shukla with fists and blows, during which Krishna Sahu struck him on the head with an iron rod and Mahendra Rajput assaulted him with a stick, causing him to sustain grievous head injuries. Furthermore, when Suryakant Rajput reached the spot
5 after being informed about the incident, the accused persons again assaulted him with an iron rod and stick. Thereafter, when Gokul Rajput and Uttam Rajput attempted to intervene and rescue him, they were also beaten by the accused persons with rods and sticks, as a result of which all the injured persons sustained grievous injuries. Medical opinion indicates that the injuries were of such a serious nature that, in the absence of timely medical treatment, the same could have proved fatal, as such, looking to the seriousness of the crime, the manner in which the accused assaulted the four injured persons and the grievous injuries sustained by the four injured persons, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, the bail application of applicant- Shravan Sahu, involved in Crime No. 561/2025, registered at Police Station Takhatpur, District Bilaspur (CG) for the offence punishable under Sections 296, 351(2), 115(2), 190, 191(1), 118, 109(1) of BNS, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and concluded the trial expeditiously. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
