Parashar, learned Additional Public Prosecutor, Assam for the State respondent. 2. Pursuant to the order of this Court dated 26.05.2026, case diary has been produced before this Court. Perused the same with the assistance of Mr. Parashar, learned APP for the State, to consider the application under Section 482 BNSS, 2023, filed by the applicants, namely, Shaynaj Begum Mir and Abdul Hannan Laskar, who have been apprehending arrest in connection with CID

Sections 120(B)/406/409/419/420/468/471 IPC, read with Sections 66(C)/66(D) of the IT Act, 2000. 3. It is to be noted here that the above noted case has been registered on the basis of one FIR lodged by the Director, Assam Minorities Development Board and State Nodal Officer, Pre-Matric Scholarship for Minorities, Assam, on
29.08.2020. The allegation, against the present applicants, is that they are involved in siphoning of funds meant for scholarship of minority students, presently studying at Kendriya Vidyalaya at Nazira, Sivasagar. 4. It is also to be noted here that the applicants were granted pre-arrest bail by a Co-ordinate Bench of this Court, vide order dated 26.05.2026, with direction to appear before the Investigating Officer. Accordingly, the applicants have appeared before the I.O. and their statements were also recorded. Page No.# 3/4
5. Mr. Ali, learned counsel for the applicants submits that the applicants are innocent and they are no-way involved with the offence alleged in the FIR and a CSP was allotted to the applicant No. 1, but the same was closed long back. 5.1 Mr.
Ali also submits that the applicants were granted the privilege of interim bail by this Court, vide order dated 26.05.2026, and accordingly, they have appeared before the Investigating Officer and their statements were also recorded and since, they are cooperating with the investigating agency, it is contended by Mr. Ali that the interim prayer granted to them may be made absolute, in the same terms and conditions. 6. Per contra, Mr. Parashar, learned APP has opposed the application. Referring to the statement given before the Investigating Officer by the two applicants, Mr. Parashar submits that they have not been cooperating with the investigating agency and under such circumstances, he has contended to dismiss this petition. 7. It appears that the applicants are cooperating with the investigating agency and in view of the cooperation being extended by the applicants to the investigating agency and also, in view of the materials collected so far in the case diary, this Court is of the view that custodial interrogation of the applicants, in the interest of the investigation, seems to be unwarranted in this case and it also appears that the I.O. got sufficient time for investigation from the time of registration of the case in the year 2020. 8. In that view of the matter, this Court is inclined to make the interim order dated 26.05.2026, absolute, in the same terms and conditions. Page No.# 4/4
