have been identified by their counsel and the Investigating Officer (IO) concerned, Police Station Vasant Kunj, Delhi.
7.
Brief facts of the case are that the Petitioner was undertaking construction work at a site where, on 24.11.2025, Late Sh. Narendra Ahirwar, a labourer, sustained fatal injuries after a monkey lift/crane fell from the second floor while he was operating it. He succumbed to his injuries on
27.11.2025. Consequently, FIR No. 0489/2025 was registered at P.S. Vasant Kunj South under Sections 290 and 125(a) of the BNS, and Section 106 BNS was added after his death. The FIR was lodged by Jagram Choudhary (who used to work with the deceased), and the present criminal proceedings are being pursued by Respondent Nos. 2 and 3, being the wife and mother of the deceased.
8.
Learned counsel for the Petitioner submits that the parties decided to amicably resolve all their disputes and differences and entered into a Settlement/Compromise Deed dated 21.01.2026, executed between the Petitioner and Respondent No. 2 (Respondent No. 2 acting on behalf of all the legal heirs of the deceased). By way of the Settlement, the parties essentially agreed that, upon the Petitioner paying a total financial assistance of Rs. 5,00,000/- (Rupees Five Lakh Only) to Respondent Nos. 2 and 3, along with the other legal heirs of the deceased, the Respondents shall withdraw all pending cases and criminal proceedings against the Petitioner. 9. In terms of the Settlement Deed, an amount of Rs. 4,00,000/- (Rupees Four Lakh Only) has already been paid by the Petitioner to Respondents. The remaining amount of Rs. 1,00,000/- (Rupees One Lakh Only) is being paid by the Petitioner to Respondent No. 2 today before this Court by way of Demand Draft bearing No. 611689. 10. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. She further states that she has received all the payments due to her as per settlement and therefore, she has no objection if the present FIR is quashed. 11. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 12. Accordingly, FIR No. 0489/2025, registered at Police Station Vasant Kunj, Delhi, for the commission of offences punishable under Sections 290/125(a)/106 of BNS and all consequential proceedings emanating therefrom are quashed. 13. The present petition, along with pending application, stands disposed of. 14. The order be uploaded on the website forthwith. MADHU JAIN, J.
