2026:JHHC:1748 1 IN THE HIGH COURT OF JHARKHAND, RANCHI ---- A.B.A. No. 341 of 2026 ---- Saddam Ansari, aged about 26 years, son of Md. Nur Ansari, resident of Chuna Bhattha Naisarai, Ramgarh, PO and PS Ramgarh, District Ramgarh, Jharkhand .... Petitioners -- Versus -- The State of Jharkhand .... Opposite Party ---- CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI --- For the Petitioner :- Mr. Zaid Ahmed, Advocate For the State :- Ms Sushma Aind, Advocate ---- 2/22.01.2026 Heard learned counsels for petitioner and for State. 2. The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No.106 of 2025, for offence registered under section 126(2), 115(2), 109(1), 76 and 78 of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Ramgarh. 3. Learned counsel for petitioner submits that the petitioner has earlier moved in this Court in ABA No.5510 of 2025 which was dismissed as withdrawn by the order dated 18.9.2025. He further submits that now a good sense has prevailed between the petitioner and the informant and both of them have compromised the matter and pursuant to that, the second anticipatory bail petition has been filed before the learned Sessions Judge, however, the same has been dismissed considering the sections are not compoundable. 4. Learned State counsel opposes prayer and submits that the sections are not compoundable, however, she is not disputing the 2026:JHHC:1748 2 fact and the compromise has been arrived at in light of Annexure-2. 5. Considering that the compromise has been reached between the parties and under the changed circumstances the second anticipatory bail can be entertained and the compromise petition has been annexed with the petition, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Ramgarh, in connection with Ramgarh P.S. Case No.106 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023. ( Sanjay Kumar Dwivedi, J.) 22.01.2026 SI/
