THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks for the following reliefs:- “ i) To call for entire records in O.S.No.109/2026 on the file of the Principle Civil Judge and JMFC, at Madhugiri and quash the impugned order Dated: 11.02.2026, passed on I.A.No.1/2026, vide Annexure-D-2. ii) Grant an order directing the respondents No.1 to 4 from not to change Poojari/Archakship of the petitioner - 4 - HC-KAR NC: 2026:KHC:10666 WP No. 5056 of 2026 by making pattabhisheka to Guruprasad s/o Jannappa till pending disposal of the suit. iii) Grant such other order/s as this Hon’ble Court deem fit to grant in the circumstances of the case in the interest of justice.” 2. Heard learned counsel for the petitioner and learned Senior counsel for respondents 6 to 9 and perused the material on record. 3. Learned Senior counsel for respondents 6 to 9, on instructions, submits that if the petitioner – plaintiff furnishes copies of the writ papers, suit papers etc., they would file their written statement, objections, documents etc., in the suit before the trial court on 16.03.2026 and the trial court may be directed to pass appropriate orders on I.A.No.1 for temporary injunction filed by the petitioner – plaintiff within a stipulated timeframe. 4. Per contra, learned counsel for the petitioner – plaintiff undertakes to furnish copies of the writ papers, suit papers, documents etc., to the respondents within a period of one week from today and the present petition may be disposed of directing the trial court to pass appropriate orders on I.A.No.1 by continuing - 5 - HC-KAR NC: 2026:KHC:10666 WP No. 5056 of 2026 the interim order passed by this Court in the present petition, which reads as under:- Heard both sides. Registry to print the name of Sri.Akarsh Kumar Gowda, as the counsel appearing for the respondents. Copies to be served. Re-list on 20.02.2026. In the meanwhile, parties are directed to maintain status-quo in relation to performance of poojas, archanas, rituals and ceremonies etc., in the subject Temple till the next date of hearing. Liberty is reserved in favour of respondents to seek vacation / modification of this order. 5. In view of the aforesaid submissions made by both sides and in the facts and circumstances of the case, I deem it just and appropriate to dispose of this petition by issuing certain directions. 6. In the result, I pass the following:- ORDER (i) Petition is hereby disposed of. (ii) The petitioner – plaintiff is directed to furnish writ papers, suit papers, documents etc., to the respondents within a period of one week from today. - 6 - HC-KAR NC: 2026:KHC:10666 WP No. 5056 of 2026 (iii) If the papers are furnished, the respondents shall file their written statement, objections, documents etc., on 16.03.2026. (iv) The trial court is directed to dispose of I.A.No.1 within a period of one month from 16.03.2026 without being influenced by the findings and observations, if any, passed in the present order. (v) The aforesaid interim order shall continue to remain in force till disposal of I.A.No.1 without prejudice to their rights and contentions of the parties.
