JUSTICE PARTHIVJYOTI SAIKIA O R D E R 30.07.2026 Heard Mr. B.K. Mahajan, the learned counsel appearing for the petitioner. Also Page No.# 2/3 heard Mr. Bhaskar Sarma, the learned Addl. Public Prosecutor, Assam as well as Mr. S. Islam, the learned counsel appearing for the informant. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner, namely- Samarjit Nath has prayed for releasing him on bail in respect of Sessions Case No.66(A)/2026 (PRC No.156/2026) pending in the court of learned Addl. Sessions Judge (FTC), North Salmara, Abhayapuri. 3. The petitioner allegedly stabbed his wife to death and after that he stabbed himself. However, he survived. 4. The medical report sent by the District Jail, Abhayapuri states that the petitioner has been suffering from neurological disorder. He even cannot go to the toilet on his own. According to the medical report, the petitioner is unable to do his daily work on his own and without support of others. He cannot stand erect and is unable to walk properly. He is unable to take food in the kitchen. 5. Mr. Islam has submitted that there is a possibility that the petitioner might threaten prosecution witnesses if he is released on bail. 6. Going by the medical report, the learned counsel for the State also agreed that the condition of the petitioner is very bad. 7. Mr. Mahajan has submitted that if the petitioner is not immediately released, his condition will worsen to a greater extent. 8. I have considered the submissions made by the learned counsels for both sides. 9. The medical report shows that the condition of the petitioner is exceptionally bad. The jail authority says that he needs caretakers for daily activities and the condition of the petitioner has not improved in spite of providing treatment in the jail. The doctors of the District Jail have reported that for better treatment, family support of the petitioner is require. 10. Under the given circumstances, this court is of the opinion that the petitioner Page No.# 3/3 Samarjit Nath deserves to be released on bail at this stage. His bail application is allowed. The petitioner Samarjit Nath shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction for the learned Addl. Sessions Judge (FTC), North Salmara, Abhayapuri. The bail application is disposed of. JUDGE Comparing Assistant
