JUSTICE BALJINDER SINGH SANDHU Order 03/08/2026 These applications for bail under Section 483 BNSS (439 Cr.P.C.) have been filed by the petitioners who have been arrested in connection with F.I.R. [2026:RJ-JP:36188] (2 of 3) [CRLMB-10079/2026] Learned counsel for the petitioner submits the complainant who was examined as PW-1 has turned hostile and does not support the case of the prosecution and in view of the same, Coordinate Bench of this Court while considering the same has already enlarged co-accused Ranjeet Singh on bail vide order dated 23.07.2026 in SB Criminal Misc. Bail Application No.8190/2026. He further submits that the case of the petitioners is similar to the case of co-accused. Learned counsel further submits that the petitioner has been in judicial custody since the date of their arrest and that the trial is likely to take considerable time to conclude. Therefore, it is prayed that the benefit of bail be granted to the accused-petitioner. Per contra, learned Public Prosecutor has opposed the bail applications. However, he is not in a position to refute the fact that the complainant who has been examined as PW-1 has turned hostile and does not support the case of the prosecution. Heard learned counsel for the parties and perused the material available on record. This Court has considered the facts and circumstances of the case and finds that the complainant who was examined as PW-1 has turned hostile and does not support the case of the prosecution and in view of the same, Coordinate Bench of this Court while considering the same has already enlarged co-accused Ranjeet Singh on bail vide order dated 23.07.2026. The case of the petitioners is similar to the case of co-accused; keeping in view of the fact that conclusion of the trial of the case is likely to take time and the prosecution has not shown any apprehension of the petitioner fleeing away from justice, in case he is enlarged on [2026:RJ-JP:36188] (3 of 3) [CRLMB-10079/2026] bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioners under Section 483 of BNSS.
